DWP issue threats of Criminal Record after indirect discrimination

I am still waiting to hear from the Department for Work and Pensions – DWP about the letter re my interview by #BarbaraClarke. So maybe they thinking denying me access is going to stop me from telling the world about the institutional discrimination I faced from 2004 in the United Kingdom. Result I have been denied my entitlement.

Let me direct HMRC where to go to get the data about my contributions in the UK to building brands from 1997. Therefore I have more than meeting  Facebook Community Standards. Lets start at google.com, I set up my website http://myvision.org.uk, years ago. But is still not able to do all that I am capable of because I was giving away the best years of my working life to employers that discriminated against me. Not only that I have had two (2) nervous breakdowns in toxic work environments. I spent the last four (4) years trying to get my life back together.

The  South London Press was the only organisation willing to come to my rescue in 2004. Otherwise I doubt if I could survive all that happened to me since. But as the www.express.org.uk columnist states “Tech Don’t Lie snd that’s why everyone is trying to deny me access. Pity they don’t seem aware of the  GDPR? As for  Acas , I have had my share of aggravations from their employees both time I take my case to the ET.  I am party of Dr Maria Hudson 2012 Research Paper Ref: 01/12 for the Policy Studies Institute. I have to fight my way to get published on LinkedIn. Because as usual I did not understand some of the terms. That’s why I am still not taking up their offer, I am not sure how I will benefit? The editor of the NWM #LizRoberts did send me an email, allowing me to work out who excluded me from the NW Forum.

I am sorry that they have waited for the horse to gallop out through the gate to put the #AccessDenied. I have put in writing for a Subject Access Request re the GDPR. I done the same of LEYF Nurseries, I was told that the only data they have is what I supplied via the Employment Tribunal Service. They don’t have any record of the CEO Long Service Awards. Yet the Employment tribunals presided over another miscarriages of justice after the King’s College Hospital debacle. I have done the same via the Ministry of Justice UK, I am still waiting after correspondences with them. I asked the Metropolitan Police Service for a transcript of the recordings in March 2018 when the Employment Appeals Tribunal exacerbated my disabilities.

So let them get Facebook to block me. I have the correspondences copied to Bates Wells Braithwaite after the reserve judgement was posted online. I have my #defensivepractice.

So did she think the photo in my passport don’t look like me? She did not know about the GDPR Informer. Niether the acronyms for HMRC. So let them bring it on and the world will know how the intitutional dicrimination is affecting me to this day.

Analysis: Earlier I was listening to BBC Radio 5 live and hear this 27 years old talking about his ordeals at the hands of the Metropolitan Police Service. I can vouch for every single word that he has said to be correct. Let me briefly tell you my story after I was threatened by Winsome Duncan: Author, Artist & Book Confidence Coach and #RyanClement. I called 2 times and was informed my concerns have nothing to do with the Police. But on 30th October 2017 the #Police and London Ambulance Service NHS Trust turned up at my house to section me.

The rest is history as I intend to make an example of LEYF Nurseries, the former employers that destroyed my life, colluding with cohorts who are part of the terrorist cell that came together after the death of my mother. The solicitors that contacted me on the 24th September 2015, Bates Wells Braithwaite, Martin Bunch.  The union that give me the union rep Darren Mahon to represent me at the disciplinary hearing. Only for him to disappear after leaving me and promising to be in touch. Voice: the union for education professionals, is still taking my fee and trying to get me to sign away my rights by resigning my membership. Since I took out a grievance against them, I have the names of those involved.

The employment solicitor, at  Advising London, who tried to bring religion into the advice and trying to keep my documents. This is despite saying she could not help me. Once she found out I did not have insurance. The Respondent’s representative, John Fenton of  Personnel Consultancy Ltd, The, who is one the most unprofessional individual I have the misfortune to deal with. But he has proven himself to be more than a liar. He masquaraded as a lawyer throughout and tried blagging his way out.

The Department for Work and Pensions – DWP, they have been the bane of my life and exacerbated my disabilities from the time I was forced to sign on for benefits. But I am sure they have something to think about? I am waiting for them to address my letter re the interview by the ignorant Barbara Clarke. Or else I will be getting in touch with http://www.equalityadvisoryservice.com.  It is worse with the Windrush Generation stories. When I get frustrated, I post my writings in the Universal Credit Journal. Serves the bigots right.

HMRC, they have acted like they have not an iota of sense. When they claimed they were not aware of me living at my address until 2015. But the idiots breach the Data Protection Act and Human Rights Act when they went into https://www.facebook,com/public/Mervelee-Myers and sent letter to me as ERMINE MERVELEE IONI MYERS. Now how did they come by that information? I choose to put that information in the public domain. I did not wish my life to be complicated as www.leyf.org.uk tried to do. My life has always been an open book.

I have had my life destroyed by people from my workplace, the professionals, organisations and the systems that triggered and exacerbated my disabilities.  London Borough of Southwark SEND Section, colluded with kINGS in 2008 to destroy my career because they feel threatened by my knowledge. But to add insults to injury they were at it again when I started having difficulties. But they didn’t know who they were dealing with when they demanded my intellectual properties and sending letter with threats of ultimatium. The coluded with the Local Educational Authority, the Local Safeguarding Children’s Board and OFSTED to ruin my career.

The editor of the Nursery World Magazine, is a bully who get 2 young white men to stalk me at the Nursery World Show 2017. I spoke to her at the Show 2018 at I get the impression she thinks she has not done anything wrong. I have her email and I was removed from the Nursery World FORUM on https://www.linkedin.com. As for  HCT Group, they have a lot to answer for with the statistics and then not allowing me to do the training to get back into employment.

Community Playthings UK – Darvell School, I have written to them about my intellectual property. They have lost their moral compass, and I pity them. Connex Education, et al are documented for the discrimination in this round of me reprenting myself at the Employment Tribunal. I have exonerated King’s College Hospital, but UNISON and Capsticks, Wimbledon will have to make amends for the first Employment tribunals when my childhood traumas was triggered and I have my first nervous breakdown. Read about it in Dr Maria Hudson Research Paper for the Policy Studies Institute when I was participant in the research. This was recommended to Acas.

So why did ACAS employees think they have the right to be calling and leaving messages on my phone? Maybe #JudgeMartin, the Employment Tribunal Law that allow my concerns to be pushed under the carpet and the miscarriages of justice should be up for a review? How about #JudgeFreer#MsFennel and #MrDixon admit to #JudgeClarke of the Employment Appeals Tribunal that they were totally out of their depth when confronted with #LEYF. It is time for the UK government to act about the scourge of discrimination that is destroying familes and turning people like #ChefGloria into people who dispising themselves.

Had a really out of Body Exp. yesterday after going for my Eye Test. Had some drops put in my eyes & the doc asked if I drive. Came out of the surgery and was nearly blinded having to feel my way around in the market & making excuses. Struggled home with 1 eye like Looka & the other like Blinks making sure I wait at the traffic lights so I don’t get run over? Got in doors started my usual Saturday routine, but had to give up as I stick the knife in my hand seasoning the chicken. Went to sleep off the drowsiness & then got up to finish the dinner & the rest of the chores & then back to bed>>> Now I know how people who were not born with a Disability have to try cope & adapt if they are eventually confronted with anything of such nature?

Having to cope with a HIDDEN DISABILITY all of my Life, has made me more Sensitive to the needs of the VULNERABLE in Society. Unless U have to stand in OUR shoes for just 1 minute no one knows the real struggle WE have to deal with to overcome the Shit that this Insensitive World throws at US in the forms of Social Injustices & Inequalities. These SII are neatly packaged in PC labelled as EQUAL OPPORTUNITY, but they are totally blindfolded as it only applies to some?

Because I know how much WE can be misjudged & our intentions Misconstrued to suit those who refused to educate themselves about OUR Needs. I have taken the stand to become an ADVOCATE for the Downtrodden & Misunderstood who are not given a Voice >>>> So when I get on my Soap Box am doing it for US because WE are SPECIAL? MAD, MENTAL or FOOL-FOOL are just some of the Labels attached as well!!!

Evaluation: Like the warning I got from #BredaKen at my Auntie’s home in January, this might be just another warning for me. Because back then, I misinterpreted the meaning of the revelation. Only much later I realised the coffin Breda Ken spoke about was to be the 4+ years of hell I am experiencing after the death of my mother. After returning from my son Valdin Legister andNaheel Julene Brown Legister wedding in Janaury 2014, I attended theLEYF Nurseries New Year Staff Party for the first time.

This was where I was destined to say goodbyes to some of the people who were part of my empowerment at Luton Street www.leyf.org.uk. If in doubt check my various social media profiles showing my contributions to building brands www.google.com.  I was to meet some of those who would be party to the discrimination I was to face later. Matters came to a head when they use our own people to separate and divide. But since this was the plots used at King’s College Hospital, where I experienced my first #nervousbreakdown, I was prepared.

Some of the cuIprits that colluded against me were/are London Borough of Southwark – SEND Section. The duplicity of the Local Safeguarding Children Board, and Local Educational Authority and Citizen Advice Bureau. There was UNISON http://unison.org.uk/ and later the corrupted Capsticks, Wimbledon.
Acas must hang their head in shame for colluding with the NHS. The evidence is to be found at www.acas.org.uk/researchpapers. And Ofsted  www.ofsted.gov.uk, don’t listen when concerns are raised because of the contingent policies and procedures of the Rules of Law.

You will find out more later when I go into details about the discrimination that caused my second nervous breakdown. In case they wondering where I get my fact from, I have been doing my research on Google. If they type in #MerveleeMyers like I did when I needed to represent myself at the Employment Tribunal Service http://www.justice.gov.uk/tribunals/employment/claims/responding again, then you will be just as gobsmocked as I was.

Without further ado let me move forward to where I am in the scheme of things. As can be viewed from the online judgement of #JudgeFreer,#MsFennel and #MrDixon, you can pick up the pattern of discrimination at the highest levels in the Justice System. But the online judgement will not give the full picture of how the Employment Tribunal Law is not fit for purpose. It won’t tell you about the rejection of my #Racism claims by #JudgeMartin. Or how the ET tried to stitch me up over the#TelephoneConcilliations. And what the judge tried doing and telling me how LEYF have to protect their company. So my case was not about principles, but money.

Well I chose not to accept the blood, sweat, tears money that would gag me and prevent me from telling the truths from the time #Voicetheunion decided to banish #DarrenMohan and leave me once again to represent myself. But not to worry they are still taking fee and trying to get me to sign away my membership. But before that I have Department for Work and Pensions – DWP criminals dealing with. Hence the reasons I could not present my Racism claims in writing. Then it was HMRC that claims they were not aware of me living at my address until later in 2015.

As a result of the discrimination by LEYF from the 27th March 2015, when #DilysEpton came to UK House of Commons Nursery to stitch me up to go on Medical Suspension. I received a letter in the post inviting me to a disciplinary. My data was tampered with and I have been having difficulties establishing my identity and status re my address since. In case your are wondering this is the outcome of the fictional disciplinary. Disciplinary Outcome will be posted online like the judgement. #UURICA_LE as I like to shorten it.

I will end by saying, the discrimination is continuing because of erronous fact supplied to #JudgeClarke of the Employment Appeals Tribunal. I was advised by the Southwark Law Centre that I have to informed the EAT about my disabilities. I should not take it for granted that they know. Ok I have #JudgeElliott Court Management Order of the 8th June 2016 to produce Medical Reports. I obtained from my GP, Dentist and the Maudsley Hospital, www.slam-iapt.nhs.uk/southwark.  I keep informing the Employment Tribunal in Croydon, United Kingdom about #JohnFenton of the Personnel Consultancy Ltd, The breaches. Nothing was done about any of my concerns.

I wrote Open Letters to Bates Wells Braithwaite#myUnion_VoiceDaily Express and David Cameron. Later to Theresa May and Neil Coyle MP. I tried taking petition to no avail. But the Metropolitan Police Service and London Ambulance Service NHS Trust can come out to section me because of the malicious call out of Winsome Duncan: Author, Artist & Book Confidence Coach.

Now I am having issues with the Ministry of Justice UK, I thinking they they too are waiting for me to become part of the HCT Group  statistic of 1 in 5 suicides are associated with unemployment? They can wait until thy Kingdom come like Nursery World MagazineCommunity Playthings UK and any other person or organisations that think they have gotten away with discrimination against me from 2004 when I had to contact South London Press, to tell my story.

Then take my claims to the Financial Ombudsman Service. They don’t know who the hell they messing with, like what my neighbour done to my husband today. Then come tell me he must go back to Peckham Rye London, where he has flat. And come talk about rights, I have given up my entitlements for a peaceful life from I moved here in 2000.

They will not run me out of the United Kingdom, until I have done my duty to Tom and ready to go back to #Jamaica.

Young Lady call about Energy. Stupid Gal arguing with me about my #address? This is as a result of what LEYF www.leyf.org.uk done to destroy my life from they sent me letter to attend disciplinary on the 28th March 2015. After the Senior HR Dilys Epton visited HOC and tried to stitch me up, then trick me and sent me on Medical Suspension. Letter came yesterday from the DWP. If undelivered please return to: Southwark Council, Revenue, PO Box 68763, London, SE1P 4DJ. At least the letter have my name and address right, but I see #Appeal… I will not open until after I get back from Westminster Abbey to celebrate the life of Sam King.
I did not get a letter from Ms Barbara Clarke as she promised when I attended the interview on the 15/5/2018, www.gov.uk. So what appeal are they talking about? I can’t wait to get back home to open the letter, if these mother fuckers think I am going to let them get away with what they have done to me, they can think again. I have my correspondences with the DWP and www.southwark.gov.uk/benefitscontact. I even have correspondences with Southwark Council Sen@southwark.gov.uk. This is about my volunteering with www.resourcesforautism.org.uk. So if www.education.gov.uk/contactus want me to open my http://register.ofqual-gov.uk, I will.
I have things to do and places to go, so will not be writing a long epestile. Or are they saying what LEYF has done, they have not data for my years of working from 1st September 2009 to 27th September 2015. I refuse to argue with terrorists.

The DWP @MsBarbaraClarke has not sent me the letter that she said she was going to write. So what fucking appeal are they sending me letter about? This is clear case of institutional discrimination.
Oh yes Winsome Duncan: Author, Artist & Book Confidence Coach called the Metropolitan Police Service and London Ambulance Service NHS Trust to section me for my own money and manuscript for my book.
But then the Employment Appeals Tribunal got in on the act with the continuation of the institutionalised discrimination.
My salvation only came because God spoke to Sally Robertson of the London Legal Support Trust.
I will go down with my Fight4justice. How the fuck can they treat another human being less favourably than an animal?

Day after Father’s Day Reflections

No one is Perfect

Taurus: Friends will show their true colours. Someone you once thought was without fault will betray a weakness. Try not to judge them to harshly. The sooner you accept their flaws, the healthier your relationship will be. After all, you’re not perfect either.
 
Evaluation: I couldn’t have said it any better myself…? But I am learning to swallow some bitter pills over the past 4+ years. I guess I have had a productive #FathersDay reflecting on my life. My life that I managed to make my own despite of my experiences of indirect and direct discrimination from the time my Papa was struck down with #Parkinsons, www.myvison.org.uk. But I have always been a #resilient person as you can read from sharing my experiences without no holds bar, www.google.com.
I am not one for embelishing the truths like some are wont to be doing, https://www.facebook.com/public/Mervelee-Myers. Trying to create a life that was/is not theres. That’s why when Winsome Duncan: Author, Artist & Book Confidence Coach, www.peachespublications.co.uktried telling me to change my book to that of a victim, I refused. I will be going to Judge Rinder to claim my manuscript. Also her #EmploymentBarrister_RyanClement, http://www.ryanclement.com/will be reported to the The Law Society for gross professional misconduct. He groomed Winsome Duncan Lyrical Healer and the coach who breach the agreement and removed me as adminstrator on Merveleeconsultancy, www.MerveleeConsultancy.ukto scam vulnerable people.
That’s why I am at loggerheads with the Metropolitan Police Service, the Department for Work and Pensions – DWP, HMRC, Ministry of Defence, and other individuals and organisations and companys that are part of the establishments and systems, intent on destroying my life. This discrimination started after the death of my mother. But the Employment Tribunal choose to preside over another miscarriages of justice because they refused to give a voice to the common people. Hence the Windrush Generation stories. So when they have #WindrushDay, I will be telling my stories about the heroes and heroines who I know and who we were not educated about as part of the curriculum. 14.1. Did the claimant resign as a result of a fundamental breach of her contract of employment?
 
In my summary I would like the Employment Tribunal Judge and the Panel to take the following submissions into considerations. In addition to the summary of my recollections of the evidence presented by the Claimant and the Respondent verbally. I am relying on the Bundles in particular the Claimant’s to back up my arguments. I would like to put forward my arguments showing me trying to resolve this matter that was none of my doing and for which I tried reasoning with the Respondent for us to settle amicably. My reason for trying to resolve the matter amicably was because of the 4+ years I spend in the Respondent’s employ where I gained the CEO Long Service Awards in October 2014.
The same time www.leyf.org.uk was given Nursery Chain of the Year Award by www.nurseryworld.co.ukDespite starting at Fitzrovia where I faced some difficulties before the end of the Probationary Period, I was made to feel welcome after I was vouched for by a former colleague who was one of the youngest managers at LEYF. I was transferred to Luton Street on the recommendations of Joelle Lax. She was one of the Panel at the Disciplinary Hearing. Therefore I am arguing that this backs up my claim that the Disciplinary/Appeal Hearing Outcomes were part of the plots I identified as a result of a fundamental breach of my contract of employment that caused me to resign.
I did everything in my power to keep my job despite the unfair treatment at BIB, HOC and New Cross from the 23rd July 2014 to 27th September 2015. But the Respondent was intent on dismissing me, ensuring they do everything to stop me from getting another job after leaving their employ. This has been the case as Barrister Jones rightly said during her questioning. The 4+ years I worked at Luton Street were the best years of my working life as I was given the opportunities to enhance my knowledge and extend my Continuing Personal Professional Developmental Plan (CPPDP). I gave back to the Respondent because by providing me with a job when I was experiencing some bleak periods in my life that triggered my disability of Chronic Anxiety into Mental Health Issues. I felt safe and secured in my job at Luton Street working to get my Pension at retirement. All my hard work, the accolades I received and my endorsements by other professionals, parents and colleagues which I valued. All were made valueless on my transfer to BIB because of what was done to trigger and exacerbate my Chronic Anxiety into Post Traumatic Stress Disorder – Mental Health Issues. Evidence of how this was done is detailed in the BUNDLES
14.2. The term of the contract relied upon by the claimant is the implied term of trust and confidence.
 
When I started at Fitzrovia there was a time before I completed the #ProbationaryPeriod when the Interim Manager Maria Goncalves tried provoking me into acting unprofessionally by making allegations against me. When I challenged her by writing a letter setting out how the unfair treatment was affecting me, the Area Manager Maria Freeman joined in to gang up against. Since Hilda Miller brought up the matter today, I am convinced that this was part of the plot to dismiss me from I transferred to BIB. There was the time when I suspected that Deputy Nicola who instigated the Banana Eating Incident was involved in breach of Contract Section 16. Confidentiality prying into my private life.
This would occur each time she attended Deputy Trainings at CO and comes back asking me personal questions about where I worked, who I worked with and if I was happy at BIB. I later learned that Hilda Miller had been going around spreading rumours about me before I transferred to BIB. This ties in with her statement about the information shared with her by Maria Goncalves about me writing derogatory letters about staff at Fitzrovia. Therefore who should be held accountable and responsible for destroying my name, character and reputation? Why did I spent 4+ years at Luton Street without any concerns raised as far as I am aware?
I tried applying all the interpersonal skills I learned via studies and trainings to try and resolve the matter with the Respondent. I even gave up my rights, waive my confidentiality to share my personal experiences in the Public Domain so I could support children and their families from going through the experiences of my traumas and my child’s transitional developments – Kevin Murray. The stories are in the ublic domain, the same way that there are reviews on LEYF Nurseries backing up my story of facing discrimination at BIB. After trying everything and they didn’t work, I lost trust and confidence in the Respondent.
There was evidence that the Respondent started a campaign to dismiss me from my job. But first they exacerbated my Mental Health Issues with the intention I would act unprofessionally so they could dismiss me for gross misconduct. That way I would not be able to get another job. I would miss out on my retirement Pension and the benefits I derived from working to make valuable contributions to my family and myself.
I informed Dilys Epton that work keeps me going because of my father’s illness which caused me to grow up in poverty and develop TRAUMAS from puberty. Dilys Epton chose to show her biases by saying that’s not what they say about you.
I have to compare myself to my pet dog that died and was buried and told her that if I was an animal at BIB, the RSPCA would have rescued me. All this started from the first day at BIB, continued at HOC and New Cross from where I resigned, with a Nervous Breakdown. This is backed up by the Court Management Order Medical Reports. Inclusive of the counselling at the Maudsley Hospital, www.slam-iapt.nhs.uk/southwark. 
By the time of my resignation, I had become PARONOID, I was constantly provoked and I was scared I might eventually commit a Criminal Act that would cause me to end up in prison where I would die like my brother.
I was left with no other alternative but to resign to save mine and my husband from certain death because of our disabilities. I could no longer identify the person the Respondent’s ill treatment cause me to become. When I had no one to turn to I played out some of the TRAUMAS on https://facebook.com/public/Mervelee-Myers, where I was not judged at the time. I wanted the world to see what the Respondent had done to me, since they still wanted to treat me like a criminal. Counselling helped me dealing with what the Respondent did to trigger my Mental Health Issues. I doubt very much I will every trust and have confidence in anyone, especially an employer to treat me the way I was treated by the Respondent as it happened before at King’s College Hospital.
I have started my Fight4justice campaign that I intend to develop into ADVOCACY.
I had to arrange my own counselling, but counselling was offered to LynneKelly because she claimed they talked about African Margaret at Rumi’s wedding and she abused 3 children. This however did not happen when LEYF operates BIB. But she was given preferential treatement. Eventually they did find a way from stopping me getting a job with the Reference flagging SAFEGUARDING.
14.3.1. The breaches relied upon by the claimant are:
 
October 2014 – Banana Eating Incident: I have come to the conclusions that the Banana Eating Incident was staged by Nicola under instructions from Leadership & Management to provoke me into acting unprofessionally to get me dismissed. My arguments are based on Hilda Miller’s Evidence. This is based on the arguments puts forward about the incident at Fitzrovia before I passed the Probationary Period in 2009.
Because of Chronic Anxiety and Diabetes I have to be able to eat so I don’t get the signs and symptoms linked to the disabilities that can impact on my life.
Going HYPO: I have never been in a HYPO, but I have dealt with my husband and I know the consequences of having a hypo. By eating the banana and it was concealed so the child did not see me, I was saving the children from becoming #TRAUMATISED if I went into a HYPO. The Respondent is not aware of the implications that’s why they keep saying I was not on medication. I am responsible for taking care of myself and I share my Safeguarding Duty of Protecting the children I work with as Paramount.
The Respondent is relying on the stringent contingent Policies, Criterion and Practice to keep me to the outdated Contract that is putting me in a compromising position. When Nicola left me in the room to go to Lynne Kelly in the office, anything could have happened. The Respondent failed to adhere to the Equality Act, 2010, by not updating the contract I signed on the 7/10/2009.
14.3.2. Lunch Break – October 2014 to September 2015: The Contract Section 6. Hour of Work:
 
Is in breach of the Equality Act 2010. The Contract has not been reviewed and updated from I signed in 2009. I am affected by my disabilities in the ways in which I can carry out normal day to day activities. The Medical Reports by Court Management Order supported my arguement. And Dr Laura Crawford Occupational Health Report does the same.
 
14.3.3. OH Medical – Reasonable Adjustments (Stress Incontinence):
It is very demoralising wetting myself and losing my DIGNITY. Working with young children all my life, I know how they react when they are toilet training. Spending time with my MOTHER who had dementia showed me how I have to be compassionate to the elderly. Despite having dementia mum tried at all times to keep her dignity. It was demoralising for me and made the disabilities of Chronic Anxiety even worse, making it harder for me to do my job. I started become PARONOID about what could happen to me if I am caught short when I have to travel on Public Transport to get to work. The Judge allowed Barrister Jones to redicule me about my disabilities throughout the ET. However the ET was adjourned on her manufactured contagious disease. Because she admitted to the Employment Tribunal, http://www.justice.gov.uk/tribunals/employment/claims/responding, she did not prepare a case.
14.3.4. Working in Under 2 Room:
I have always been flexible during work and is willing to fulfil my Job Title/Description re the Contract Sections: 1-33. However I took the job on condition I would not work permanently with younger children because of health conditions. I was always conscious about the Health & Safety at Work Act 1974 re: Safeguarding. I did not wish to put the safety of the children and myself into any compromising situations.
I am convinced that I was been set up to challenge managers/deputies so they can have evidence I breach the Contract. This goes back to what Area Manager Maria Freeman told me in 2009 at Fitzrovia. Since Hilda Miller brought the matter up, I have to conclude that this is a grudge that they have against me.
If you look at the statuses of the 7 Witnesses, it is evident that the Respondent operates hierarchical cronyism based on friends in high places. After I served my purpose, the Respondent was ready to dismiss me making sure I couldn’t get another job. Mrs Jones keep referring to that fact throughout. Mr John Fenton of www.personnelconsultancy.com, make sure he was out of the UK for the duration of the ET case on its resumption. The question is why this was? I informed the ET about the Respondent’s non-compliance from the first time I appeared at the Preliminary Hearing on the 15/3/2016. The same time my Racism claims was sent back by Judge Baron for reconsideration.
14.3.5. Working at HOC – Longer Journey to Work:
 
I wasn’t concerned about not been reimbursed, but the fact that I might wet myself if I get the urge to go the toilet because of Stress Incontinences.
14.3.6. Rumi’s wedding:
 
This was where the plot that I believed was planned with sanction from CO Leadership & Management started to take shape. Why would I be saying derogatory things about Luton Street? Refer to Publication LEYF On My Doorstep on LinkedInWhat the Respondent done to me destroyed my fragile Mental Health Issues into DEPRESSION – refer to email to Dilys Epton 14.03.2015. I am unable to trust anyone ever again. I hate to keep looking over my shoulders.
In order to not act unprofessionally, or become physical I shared my frustration on Facebook. I warned the Respondent about my intentions in writing. They did not take any actions after I wrote an Open Letter to the solicitors Bates Wells Braithwaite with attachments. The solicitors did not contact me again and did not represent the Responden, as far as I was aware. But after the judgement was posted online they got back in touch. They get Facebook and Twitter Legal Team to contact me, and I have responded and waiting for the next moves.
14.3.7. Complaints/Investigation-Disciplinary:
This was used to try get me dismissed. When this did not work, I was transferred to HOC where allegations were made. But the Respondent breached the Contract putting me in the Baby Room and offering me a job working in the Baby Room where there was a vacancy. The reviews on LEYF website from March 2016 prove my stories of discrimination. The letters I wrote about my emotional wellbeing after coming back from my mother’s funeral should be taken into consideration. Also the verbal and written statements of the witnesses. As well as Jyoti Sharma aka Jyoti Bhardwaj as nmaed in the bundles review on LEYF website in March 2016. The ET allowed LEYF to get away with perverting the course of justice. By not accepting my additional Witness Statement as exceptional circumstances. Rashid Iqbal had resigned but continued coming to the ET, telling lies.  
14.3.8. DBS Renewal:
 
This was a deliberate attempt to get me dismissed saying I breach Contract Section 30. Change of Circumstances. Barrister Jones keep referring to the fact that my name is MERVELEE TOMLINSON for a reason. The Respondent want to say I did not inform them about this. The Respondent changed my address on correspondences from I received the Invitation to the Disciplinary. The Respondent refused me access to my FILE. My email was used to make online DBS application that was withdrawn. I did not do that. Lynne Kelly once tried tricking me into getting my email to break into my Social Media. The Respondent is capable of doing anything. There are FAKE NEWs on Social Media and I don’t put it pass the Respondent to discredit me further.
New member of staff on Probation was treated differently even though she did not have a DBS. I have a DBS from another organisation, Resources for Autism. It was not appropriate practice for the Respondent to ask me to bring that DBS to copy.
I had to get a new DBS when I started volunteering despite having one for the Respondent. Why did Hilda Miller advise #DeputyLouise to ask me to bring the DBS in, but wait until I was alone with her in the building? This is another clear case of how they were trying to provoke me to act unprofessionally to dismiss me before the Final Written Warning expired on the 8th October 2015.
14.3.9. Hilda Miller – Using my Vulnerability to get me to act unprofessionally:
 
Hilda Miller has been doing this from the first time we met in BIB, until the last meeting on the 10.09.2015. Why has Hilda Miller and others from Leadership and Management resigned? I made no secret about my struggles with my hidden disabilities, childhood traumas and progressional health conditions with the aging processes. My life is an Open Book by choice.  
 
14.3.10. Meeting with Neil King & Dilys Epton:
 
I was called to the meeting after attending Middlesex University on the 19th September 2015. I met 2 Professor Chris Pascal and Tony Bertram. After networking and telling the Professors about my intentions to go back to Jamaica to make contributions to SEND.
The Professors asked to be included in my photographs as they work in Africa & the West Indies (Refer to LinkedIn post). Professor Tony Bertram has been promoted to British Association of Early Childhood Education (BAECE) or Early Education.
How come I can act professionally around total strangers, yet the Respondent destroyed my career and stopped me from working with the disciplinary and Suspension? Refer to Neil King & Neil Heart note re EMT at Luton Street in March 2014. Since when did my behaviours changed to warrant Mr Neil King treating me the way he did? Is that why Mr Neil King resigned his post at the Respondent?
 
14.4. Conduct relied upon:
 
Despite asking Dilys Epton when she visited BIB on the 30.01.2015 for support because the ill treatment triggered and exacerbated my Chronic Anxiety into Mental Health Issues. None was forthcoming. The Voice: www.voicetheunion.org.uk for education professionals Rep Darren Mahon have to mention this at the Disciplinary Hearing – (refer to email 14.3.2015 & Disciplinary Hearing Outcome).
14.5. Resignation:
 
Refer to my Resignation, I just could not cope any more. The Medical & Psychological Reports are evidence of that.
 
14.6. Affirm the Breach:
The Bundles should contain the evidence about this. So why did the ET decide to take 5 months to copy the Respondent’s Summary and post the reserve judgement online? This is in breach of the Human Rights Act and Data Protection Act 1998. 14.7. Reason for Dismissal:
 
Exacerbating and triggering of my Chronic Anxiety into Mental Health Issues to say I am unfit for work. They tried saying I breach the Contract Section 1-33. Sent me on Medical Suspension. Provoked me to act unprofessionally so they could dismiss me for gross misconduct.
Then another suspension on the 22.09.2015 after I was harassed and bullied by Mr Neil King to try and get me to write a RESIGNATION.
They left the room on 2 occasions saying they giving me time to think after putting a pen in my presence and claiming it was mine when the Meeting ended.
Dilys Epton acted like she was scared around Neil King and Hilda Miller whenever I am in their presence.

As part of my defensive practice, I am taking the fact from my four (4) years of ordeal, trying to get justice to the forefront of the public glare to see how vulnerable employees are left at the hands of Modern Day Slavery employers. (Edit 13/6/2018: From the first time I meet Mr John Fenton at the ET on the 15/3/2016, he has done nothing else but lie. I have brought Mr Fenton’s unprofessional conducts to the ET in writing. During the ET case, I informed the Judge about Mr Fenton’s non-compliance of the Court Management Orders. But Judge Freer keep sweeping my concerns under the carpet. In particular about the missing Medical Reports. I would like someone to explain to me why the Respondent’s Representative should choose to be away and out of the UK at such a crucial time? Mr Fenton admitted after the ET case was adjourned that he is not a Solicitor, but at the same time get the oath I was placed under lifted. Maybe I will leave the learned persons to say why? Just so you know that the ET would not allow me to submit the new evidence. (Edit: I meet Ms Samantha Jones for the first time at the start of the ET case, when she told me basically what I thought was a load of crap. She was there to advice me, even though she was representing the Respondent. The offer don’t know if it was the [£1-2,000.00, £4,000.00 or £58,000.00], was still on the table. I wasn’t interested, so didn’t ask. But she gave me some documants and told me the case would be thrown out. I noticed she changed her tune when I told her my Stepson was with me. I later learned she asked him if he have Legal Trainings. You can work out for yourself why that was? Trevor told me she would not be in court next day and she was not. However I am not surprised as this is my second time at the ET and dealing with the likes of www.bwbllp.com).

There were seven (7) Witnesses and Ms Jones did not want me to question any of them, because according to her, it was a long time. But I who have disabilities and was representing myself, was supposed to face up to them and remember everything).

The following letter is more proof of how LEYF Nurseries was allowed to get away with discrimination of a disabled employee by the Employment Tribunal Service. But what makes this case so sinister and open for questioning is the fact that this is the second time I am experiencing institutional discrimination at the hands of the contingent Employment Tribunal Law. Here is the reason, I am telling people, I intend to live a circumspect life. No matter what I am doing about my personal life, there is no way anyone can get me to disresperct my husband. I already made it known, I have no interests in younger men. They don’t float my boat, or make my heart pound with excitement. I am not interested in your money. I have been challenging the discrimination of anyone who thinks they have a right to make my life a living hell from my childhood. But as anyone can tell you, I have been standing up to boys/men all my life. I refuse to take crap from anyone, and is known for my questioning of GOD.

The female of the species are my worse enemies as you can tell from my stories. But honestly, I am not sure why? This discrimination happened to me at another toxic workplace, where my childhood traumas was triggered into PTSD. There is a Method to my Madness in this time when everyone is sharing their experiences with disabilities and the impact of discrimination on the lives of those of us who experience Mental Health Conditions. Tomorrow I will be attending the Pre-school Learning Alliance Minds matter: protecting the wellbeing of children and practitioners in the early years.
I am part of research http://www.maudsleybrc.nihr.ac.uk/ as a result of the discrimination at LEYF Nurseries which trigger my childhood traumas into PTSD over the period of 23rd July 2014 to when I resigned with a nervous breakdown. I will not be going into too much details as my stories are documented in cyberspace.
 
I would just like to bring to the world’s attention the duplicity of the UK government, in continuing to turning a blind eye to the operation of Modern Slavery Practices despite the Modern Slavery Act 2015. That’s why the likes of Winsome Duncan: Author & Public Speaker www.peachespublications.co.uk, is still on Social Media planning to fleece more vulnerable people of their money. She done the same to me after taking my money to publish my book and then having big birthday splash… But it still hurts my gut that after raising concerns with the proper channels and authorities including the Metropolitan Police Service, I am still treated like a MAD CRIMINAL and the perpetuators of crime are scotch free to get on with it.

I worked for this company for 2 1/2 years. I was grateful for them taking me on as a first job. But not for all the stress and health problems that came with it. I feel sorry for all the lady’s at my nursery who I left behind.
For a company who tells us to be brave, nurturing, inspiring and fun. How do you expect your staff to accomplish such things with all the over worked hours and piles of paper work that you so happily force upon them. We are there to nurture the children of the future but instead worry so much on how tidy the rooms are and how outstanding the learning journeys are. There is no time left in the day to nurture let alone have fun.
Maybe now the company has stop concentrating so much at making more money by opening more and more nurseries you would take a step back and see the amount of stress and over worked your older nurseries have become. Maybe think about staffing them too, to lift the weight of over ratio’s and 25 key children per person would just be a start.
I watched a handful of good and honest members of staff leave the nursery I worked at and finally came to the breaking point of where I ( at the age of 21) had to leave for my own health.

The staff turnover at marks gate has been awful causing so many other issues. Does nobody look at the effects of one person leaving before making the decision to move another 3? Now the deputy manager will also be leaving and she is the only person that reassured us during all of these changes that remained consistent and was always someone we could talk to. The children are unsettled and as a parent I feel awful leaving my child in the care of strangers I get my husband to pick up and drop off most days as I get too upset with all the chaos in the nursery.

I said Goodbye to LEYF couple of weeks ago but I feel that I left my mission unaccomplished and I am still struggling to overcome the LEYF addiction I have, however I do feel that by moving on I have done one of the best things for my overall well being. Leyf is an organisation which has high aspirations and to achieve these aspirations LEYF likes to push its staff as much as it can without sorting the issues or giving them enough support etc. Staff at Leyf get dead busy and no extra help or time is offered to them to manage the enhanced work load. As a deputy manager I had so much to do with out having any admin day or some time off the room. I was working as a deputy, a Senco, was in the ratio 5 days a week, had key children, doing extra hours, deputy’s extra work and 3 hours a day commuting and on top of all this putting up a bully chef. I was also put in the ratio when manager was absent which also put extended pressure on the staff when I had to leave room. No doubt Staff will find themselves unable to cope with added pressure. They are already under huge pressure as due to large number of agency staff and few apprentices they end up having 15 to 20 key children each. Eventually passionate staff who want to do a good job get stressed, frustrated and drained and finally bound to leave. Unpassionate staff also leave due to.separate reasons. In addition to fix the staff problems which I mentioned above another important thing LEYF must do is to upskill and empower their management team as they are directly responsible for staff well-being for example I had to put up a bully chef which affected my mental state to the extent that it nearly put me off coming to work every morning and myself (deputy manager) and the manager could not address this effectively and fairly I believe due to lack of confidence and skill or may be sometimes management’s habit or a will to ignore issues like this but who paid the price undoubtedly me. There are job competencies there for the staff which every one needs to meet but they are just a piece of paper. This ‘Chef’ does not meet any of these competencies, intimidates the staff however still comfortably working at LEYF under the nose of even Area manager who is (I hope so) well aware of his day to day actions.

In this day and age when there is a Modern SLAVERY Act 2015, the ET reverted even further back than the SLAVERY ACT 1807. Is it any wonder I am suffering STRESS INCONTINENCE, so I am using the opportunity to tell the world the role that UNIONS play in keeping employees enslaved to the Modern Day SLAVERY Masters and Mistresses who have been given sanctions to destroy lives?
 
 
 
My Fight4justice Continues 11th September 2017.
My Fight4justice was created to show the world what LEYF Nurseries was doing to me from the time I returned from burying my MOTHER and transferred to BIB, HOC and New Cross in Southwark South London. As anyone who might be following my campaigns to clear my name and exonerate myself, they need look no further than Dr Maria Hudson 2012 Research: The Experience of Discrimination on Multiple Grounds for the Policy Studies Institute to show that although I am declared MAD by the trolls and naysayers, I am an accomplished WRITER, who will be an #Author with my first published BOOK soon.
But despite the recommendations to Acas, I doubt very much has been done to implement the recommendations. Otherwise I would not have been left to experience another miscarriages of justice at the hands of the Employment Tribunal Service. I have more than my fair share of stories to write about my experiences of facing discrimination since I arrived in the UK from 1992 to date. Believe me some of what happened to me are not good and do not make for pretty reading.
And most concerning does not make anyone feel positive and reassured that they will get justice from reading about the atrocities in the Mother Country in which I was expecting the systems and establishments to adhere to the legislations, laws, codes of practices and conducts. But instead I have had to deal with workplaces discrimination that ruined my life and career prospects the second time around.

The Local Educational Authorities, London Borough of Southwark SEND Section sen@southwark.gov.uk, and Local Safeguarding Board and Primary Schools. Solicitors Capsticks, Wimbledon, #JohnFenton http://www.personnelconsultancy.com, Bates Wells & Braithwraite London, http://www.bwbllp.com. Advising London and Barrister #SamanthaJones are all cut from the same cloth when it comes to dealing with the Vulnerable Employees.
I want the Public to take stock of my Facebook, LinkedIn, Google and Twitter to see if I have not been a CREDIBLE WITNESS? Throughout the time I joined the first Social Media platforms in February 2010. But what hurts me the most is how the 3 Judges allowed themselves to be CONNED at the ET case from the 20th -21st December 2016 and then again on the 28th February – 3rd March 2017. This is a sad indication of how the vulnerable employees are victimised and scapegoated into becoming the #VULNERABLE_VOICELESS because of direct and indirect discrimination. Now can the 3 judges examine their conscience please?

How my thirst for knowledge rescued me… The GDPR & Connection

Today on the implementation of the General Data Protection Regulations (GDPR), I take greatest of pleasure in making my implicit knowledge explicit about the way I made use of the opportunities I am afforded with to empower myself. This was from the time I arrived in the UK on the 7th June 1992, and starting at the bottom working my way up the ladder. However I am at a sad place in my life, starting from the time I came back from burying my mother and transferring to a new workplace site on the 23rd July 2014. My life have been changed forever and I am now waiting on closures from the former employers, London Early Years Foundation (LEYF Nurserieswww.lefy.org.uk to put the matter behind me. In that way I can pick up the pieces and the threads together and get on with my life. Therefore I have introduce the following in my story.

Sources of continuity, familiarity and consistency… Trusted Family, Friends & Beliefs

Let’s start with my horoscope that I have been reading religiously every day for the past four (4) years hoping the Gods will smile down on me and release me from this torture? Taurus: You’ll get a rare opportunity to realise a cherished dream. If your best friend or partner has been urging you to get an advanced degree, display your creative work or change jobs, you should go for it. Help from unexpected sources will arrive.

Evaluation: I am upset about what have been happening to me in the UK, for a variety of reasons. But primarily for the fact that my career was first put on hold and then destroyed over the period of 2004 to 2015. Between that times I represented myself two (2) times, at the Employment Tribunal. Both times the Employment Tribunal Service presided over the miscarriages of justice that left me a victim to fraudsters and scammers as well as blacklisting and networking. If in doubt about my credibility as a witness, without any legal trainings, just go to Dr Maria Hudson 2012 Research Paper – Ref: 01/12 recommended to Acas: research@acas.org.uk, www.acas.org.uk/researchpapers. However the recommendations to ACAS was not implemented. My Racism claims were strike out repeatedly by #JudgeMartin, despite #JudgeBaron’s intervention at the Preliminary Hearing and sending it back for reconsideration.

I informed the Employment Tribunal Law about the non-compliance of the Respondent’s Representative, Mr #JohnFenton of Personnel Consultancy Ltd, The www.personnelconsultancy.com. This was from our first meeting at the Preliminary Hearing on the 15th March 2016. That’s the time I asked about the Respondent’s solicitors Bates Wells Braithwaite www.bwbllp.com.They first contacted me on the 24th September 2015. Mr Fenton pushed the matter under the carpet. The ET http://www.justice.gov.uk/trib…/employment/claims/responding, chose to turn a blind eye to my concerns as can be seen from me having to pursue my claims to the Employment Appeals Tribunal. My ordeals becoming even more burdensome and impacting on my disabilities and my Mental Health Conditions in particular. Because the EAT was fed with some erroneous facts that I am still at a loss knowing where they came from?

The Equality Act 2010, Data Protection Act 1998 & GDPR 2018…

I have had two (2) significant bereavements, losing loved ones, my brother suddenly to colon cancer in 2008. Strangely enough that’s when the discrimination that started in 2004 in the workplace was escalated to the point when I started questioning my sanity. Because my childhood traumas were the onset of my father who was struck down with Parkinson’s disease suffering for years before he was released when death intervened. My life was changed forever by the time I was transitioning through puberty. That’s why I pride myself on claiming the status of “I am an expert-authority on subjects from the cradle to the grave” in my bibliography. But what haunts me to this day is the fact that despite having a diagnosis for chronic anxiety, the GP refuse to give me a Medical Report for the ET. I must make it clear that the discrimination happened at King’s College Hospital, workplace nursery. I have since had counselling at the Maudsley Hospital www.slam-iapt.nhs.uk/southwark. Therefore the NHS has exonerated themselves.

Rule of Law: British Values 2014, Counter Terrorism & Security Act 2015, Modern Slavery Act 2015

I chose to make my life an Open Book for a variety of reasons, but primarily for the fact that I realise, I know the triggers for my hidden disabilities. And what make me tick, the better I am able to manage and control my conditions. Little did I know that some unscrupulous employers and their cohorts would be using my vulnerabilities to destabilise me, in two toxic workplaces environments. The first time it happened I was determined to stand up for my beliefs and live my life by the old fashioned values and principles I was brought up with. But I had no idea of the impact on my health and wellbeing, taking a stance and challenging social injustices and inequalities would have on my life.

All my life I live with this fear of becoming ill and unable to take care of myself as a result of the experiences of having my family who suffered ill health and disabilities. And later died after years of suffering. During that time I lost family to brutal murders that impacted on me and other family. My grandmother died of a broken heart after the murder of her son, my uncle. My mother, her only remaining child, having to pick up the pieces, caring for her husband, my father and now her mother. Of course my granny had other complications which led to her having a series of ill health episodes, linked to her disabilities. In the space of a month my family was burying my father and grandmother. Just imagine the impact on me, when I take on dad’s signs and symptoms of Parkinson’s disease? That’s why I will not become a voiceless vulnerable and let UNISON http://unison.org.uk, get away with the part they played in destroying my career.

I have had two (2) nervous breakdown, in two (2) toxic workplaces between 2004 and 2015. But what did the ET do, make me a victim, because I refuse to conform to the bullying, harassment and intimidation of LEYF and their cohorts. I have had others joining LEYF to discriminate against me, for no other reasons than I am only one insignificant person. I have no one to stand up for me. Even some of my own family and friends abandoned me because I refuse to be a voiceless vulnerable. However I am laying down the gauntlet to everyone that I value myself and is aware of my own worth. So I will be as narcissistic about myself as I want to be.

The Windrush Generation Stories… Discrimination is against the Rule of Law…

I will start by sharing this little excerpt from my husband who came to the UK in Easter Season of 1956. A few years before I was even a twinkle in my parent’s eyes. My husband being an ambitious person, like most of his generation. And coming from the traditional customs and norms passed down through family, continue to make his contributions to building the UK and bettering his standings in life. So applied for a loan at one of the financial institutions. Only to be informed by the Bank Manager: “Mr Tomlinson, you have a small illusion that one day, you can become a property tycoon”? Certainly this is discrimination, or is this not part of the Rule of Law? Because if you go back and look at Dr Maria Hudson’s Research, for the Policy Studies Institute, you will see how it is littered with discrimination of the protected characteristics in the Equality Act, 2010.

Read my story at South London Press www.icsouthlondon.co.uk. This goes back to 2004 and is more proof that discrimination is rife in any society that will treat one human less favourably than another. In my case I was used and abused by my former employers and then they turned around and tried destroying me. Using my vulnerability of having disabilities against me, after taking the best years of my working life.

Now take a step forward to my ET case with LEYF and the aggravation by the UK government departments that leaves me unable to get my life back on track. What the Windrush Generation are going through did not just start yesterday. As far as I am concerned my brush with discrimination started in 2004 when I was defrauded of my hard earned money at the hands of the Banking Institutions that then treated me like a criminal. My reflections leave me with no other alternatives than to look at the patterns of discrimination unfolding.

I can pinpoint the organisations and government departments involved. Namely the Department for Work and Pensions – DWPHMRC, the Metropolitan Police Service and the Ministry of Justice UK. What I want the readers to consider is the fact that I have written Open Letters, including to David Cameron and Theresa May. I have contacted Neil Coyle MP and the rest is history. I have been sharing my stories with Daily Expresswww.express.org.uk about my battles with disabilities and Mental Health Conditions in particular. But because I am not a celebrity, I am not given a voice. Guessing I am not important enough to sell newspaper? Therefore I go about creating my own outlet for sharing my stories across Social Media platforms as I learned when I first attended JT Foxx Organization free training.

That’s why I have been making my implicit knowledge explicit from the time I joined Social Media in February 2010. Where is the Consistency, Familiarity and Continuity lacking in Society…?

I will end with the excerpt from the Daily Express, the newspaper my Tom introduced me to. One of the reasons is the fact that I heard one of the delegates/speaker at the Alzheimer’s Society Annual Conference 2018 make reference to the fact that changes were made to his article published in the paper. I have written Open Letters, one to the Daily Express about my plight at LEYF. For the expressed reason that I contributed to the Mental Health CRUSADE run by the newspaper.

But I think, I was expecting too much that my story would be told. I contacted the Daily Express even more recently about my upcoming EAT case, but still no response. Therefore I will end by saying now I have got representations from Cloisters www.cloister.com, and I am no longer alone in my struggles, who knows? I completed 10K for the first time doing the London Legal Walkwith the London Legal Support Trust. I can now try getting on with my life, knowing the burden of representing myself is with others with the expertise to do so.

Windrush cases sour to 5,000. The number of ‘potential’ Windrush cases reported to the Home Office has passed the 5,000 mark. They are among a total of 13,000 calls to a specialist unit set up after the scandal erupted earlier this year. Many of the Windrush generation named after a ship that brought migrants to Britain from the Caribbean in 1948, don’t have enough formal documentation, which has led to some losing their jobs and homes and being denied health care. Home Secretary Sajid Javid has announced new legislation designed to help end the crisis. The Home Office also disclosed than 850 people now have document following an appointment with their team. Mr Javid said: “I want to swiftly put to right the wrongs that have been done to this generation and am committed”.

I am part of more research, which means I will not be the statistic of 1 in 5 suicides are associated with unemployment according to HCT Groupwww.hctgroup.org.

Instead my counselling at the Maudsley Hospital www.slam-iapt.nhs’uk/southwark resulting from the advice of Dr Laura Crawford to get Cognitive Behavioural Therapy sees me living a better quality of life.
