The Personnel Consultancy was established in 1995 by husband and wife team John and Diana Fenton. They are both HR / Personnel Managers with over 20 years experience in all areas of HR / Personnel, within many types of organisations.

John Fenton specialises in employment relations and law. He regularly trains both line managers and HR specialists throughout the UK. John advises and represents many organisations at Tribunals. Since 1999 John has facilitated regular training events for the Chartered Institute of Personnel Development.

Diana Fenton focuses on performance and development issues in the work place as well as having an expert understanding of employment law. She regularly works with individuals facing personal difficulties in their working life and supports organisations in providing training and development opportunities for their staff.

Ruth Jones is a generalist career HR professional, with over 20 years experience. Her strengths lie in the practical implementation and management of change – across redundancy and downsizing; start ups and organisation growth; and mergers & acquisitions, including TUPE. These skills are biased towards employee relations, particularly around effective employee communications.

Updates 21/11/2018: The above was taken from the internet on the 21st November 2018 as part of my research into the operations of Mr John Fenton who represented LEYF as their solicitor from 3rd March 2015.

This is to be used for Research in establishing if Mr John Fenton committed any Criminal Offences by representing www.leyf.org.uk as a solicitor. And colluding with www.bwbllp.com to encourage https://twitter.com and https://www.facebook.com Legal Team to harass and intimidate me after https://www.gov.uk/employment-tribunal-decisions/ms-m-myers-v-london-early-years-foundation-2300047-2016 was posted online making me a victim and target for terrorists.

I need to find out the role of Barrister Samantha Jones www.7br.co.uk & https://www.directaccessportal.co.uk in perverting the course of justice by misleading http://www.justice.gov.uk/tribunals/employment/claims/responding. And further going on to misleading LondonEAT@hmcts.gsi.gov.uk and www.justice.gov.uk/tribunals/employment-appeals/ to claim that I made up my disabilities by lying and deception.

If my dealings with Mr Fenton when he was representing LEYF is anything to go by. There are some serious questions to be answered about the operations of this firm. Notwithstanding the email sent to me by mistake by Mr Fenton. I am not bothered because I have been keeping a defensive practice. Otherwise, I might have begun to believe some of the lies that Mr Fenton told.

My Write up as part of my Fight4justice www.MerveleeConsultancy.uk and http://myvision.org.uk campaign to clear my name. After I appeared in www.acas.org.uk/researchpapers and my career was ruined. My name and character blackened and destroyed because of jealousy on the part of the former employers and colleagues. Now the Employment Tribunal Services presided over another miscarriage of justice. Once again when http://unison.org.uk is in the limelight after overturning the government law to charge employees fee to take employers to the Employment Tribunals.

There were others from www.ofsted.gov.uk and the sen@southwark.gov.uk who were prepared to turn a blind eye back then. Not much seem to have changed all these years later. Back then I have a diagnosis for chronic anxiety 18th July 2006. This time my childhood traumas was triggered into PTSD after the death of my mother. I was passed fit for work, but the ill treatment continued for months, despite raising concerns. It didn’t stop until I have a second nervous breakdown in a toxic workplace in the UK. Once again I am treated like a second-class citizen by the ET. But to add insults to injury an EAT judge claim I made up my disabilities on the 19/10/2018. Despite me raising concerns about non-compliance when I presented www.slam-iapt.nhs.uk/southwwark.

I hope Voice: the union for education professionals don’t think they are exempted. Neither are Community Playthings UK and H C T Group. The rest will be named in due course.

Well I did get back to some of those LEYF Nurseries hiding behind to do their #DuttyWuck. So let me see what’s next. From them calling that #Parents did not know of my visits to their #School. To been accused of making #PersonalCommentsAllegations… Well very soon we shall all be knowing who knew of my #Circumstances? My Fight4justice will filter out those who make #Allegations, are #Liars, #Discriminators or even #ModernDaySLAVEDrivers with #PsychopathicTendencies.

Judge Shanks uses Hate Crime to Discriminate against the Disabled!

EAT HHJ Shanks destroyed 26 years of my life in the UK on 19/10/2018

To the Employment Appeal Tribunal
4th April 2018

All I am going to say in response to the letter dated 21 March 2018, to which I am just seeing is the fact that the directives in this letter mean I am on the verge of yet another NERVOUS BREAKDOWN. The same thing has been happening to me from I started trying to clear my name. I have kept http://www.justice.gov.uk/tribunals/employment/claims/responding, informed about www.personnelconsultancy.com non-compliance. The last time was when I was to return the documents by the 5th December 2017 to LondonEAT@hmcts.gsi.gov.uk. Only for the EAT to #penalise me for trying to take control of my #disabilities so as not to breach the conditions. I will be telling the world about how the Employment Tribunal discrimination of me from the time I was part of Dr Maria Hudson 2012 Research Paper Ref: 01/12 recommended to Acas: research@acas.org.uk, www.acas.org.uk/researchpaper for the Policy Studies Institute has led to this.

Then I will direct them to what was done to me at https://www.gov.uk/…/ms-m-myers-v-london-early-years-founda… left me open to becoming a #victim for all and sundries to discriminate against me with the hate crime. Here are some of the Legal Entity that has set me up to be #labelled as a MAD CRIMINAL. I will start with the EAT, because I called the office for #guidance about preparing the paperwork. I explained to the person about my Mental Health Conditions that were been #exacerbated as a result. The Equality Act 2010, states that people with disabilities must be given extra time. I will make sure I get my rights under the GDPR.

I was used as statistics in www.hctgroup.org.uk HCT learning centre Group Impact Report 2016 Changing Times, Lasting Impact Page 9. 1 in 5 of all suicides are associated with unemployment. This was pointed out to me by #BarristerRyanClement http://www.ryanclement.com/, my coach Winsome Duncan Employment Barrister, who she introduces me to. Because of the #blacklisting and #networking which mean I am unable to get a job. I have an agreement with www.peachespublications.com Winsome Duncan: Author, Artist & Book Confidence Coach to help me set up an online business.

This came to an abrupt end when she called the Metropolitan Police Service Police and Ambulance Services to #section me under the Mental Health Act. I have since had to be trying to stay ahead of dealing with the events that are about to make me a #scapegoat of the discrimination of LEYF Nurseries www.lefy.org.uk and the http://www.justice.gov.uk/trib…/employment/claims/responding.

I am been made a victim of Appeals@met.pnn.police.uk. LondonEAT@hmcts.gsi.gov.uk, www.justice.gov.uk/tribunals/employment-appeals/ and believe me, I refuse to be a #voiceless victim. All the EAT is doing is using my VULNERABILITY of having disabilities against me.

The day before I was due to submit the documents to the EAT, I was further stressed by the Department for Work and Pensions – DWP www.gov.uk directives. Setting me the date for an interview on the 19th April 2018, about whether I am entitled to benefits. I did not make myself unemployable and only left to be www.direct.gov.uk/carers existing on benefits.

I will end by saying that on the day we celebrate Dr Martin Luther King, I will not be afraid to tell the world about what the MOTHER COUNTRY has been doing to destroy me as a VULNERABLE BLACK WOMAN with DISABILITIES who despite my childhood traumas of overcoming  #obstacles and #challenges, until the discrimination in 2 workplaces in the UK. The first at King’s College Hospital, when UNISON, the SEND Section of London Borough of Southwark, the powers that be at Ofsted, et al set about to ruin my carer. Then Capsticks, Wimbledon acted like Bates Wells Braithwaite is doing now.

Let me tell you what a bank manager told my husband all those years ago “MR TOMLINSON, YOU HAVE A SMALL ILLUSION THAT ONE DAY YOU CAN BECOME A PROPERTY TYCOON”?

Now I tried to start a #Petition, and here is the response. Dear Mervelee Myers, We rejected the petition you supported – “Review of the Employment Tribunal Laws stopping discrimination of #employees”. It included the reserve judgement of the EAT that is  #confidential, #libelous, #false or #defamatory information, or a reference to a case which is active in the UK courts. We have marked this petition as confidential because of the personal information you’ve included. In any case, we can’t accept your petition because it’s not clear what action you’d like the Government or Parliament to take. We only #reject petitions that don’t meet the petition standards: https://petition.parliament.uk#standsards.

Someone is having a laugh at my expense. On the day when PM Theresa May May is using #rhetoric about MARTIN LUTHER KING #Legacy. I am challenging the EAT to go back and look at Dr Maria Hudson recommendations to ACAS. You will be #responsible for whatever happens to me under the GDPR.

I have since had to call out www.londonambulance.nhs.uk/talking_with_us/use_your_personal_information.aspx#clinical. Because of the way Judge Shanks allowed Samantha Jones to lie at the EAT. Then he had the gall to tell me I made up my disabilities. After he brought a black man to sit beside him, showing us how Modern Slavery is worse now than in 1807. With his blinking tokenism. I have had to seek advice from www.slam-iapt.nhs.uk and slm-tr.SPTS@nhs.net. I will leave the rest for now. But the ET and EAT will have to answer why they failed to take my concerns into considerations. And Judge Shanks and the Panel at the ET will have to say what they done with my Medical Reports I handed to them on the 20th December 2016. They are the liars along with Samantha Jones and John Fenton.

Mervelee Ratty Nembhard Is it any wonder that The Law Society#Gazette carry this Shouting employment judge went ‘a little over the top’ but was not biased. By John Hyde 31 May 2018. Because writing this in March 2018, one pompous racist offensive #JudgeShanks was spouting such vitriol as the bully that he is. That’s why he came to the EAT on the 19th October 2018 with a #black man in tow to tell me I made up my disabilities. Then he is talking about Bar Association. If he was born from a woman he would be wrapping himself in sackcloth and ashes. He seems to have a penchant for offending women, especially those of us with disabilities. I am wondering why?

Why did LEYF Nurseries not share with the #EmploymentTribunals. That may mean they have to reexamine the fact. Then the judgement at https://www.gov.uk/…/ms-m-myers-v-london-early-years-founda… would be proven a sham and white wash.

Updates 11/11/2018: This is for LondonEAT@hmcts.gsi.gov.uk. Why did they not look at the Listing in the bundles. But yet they confiscated my bundles with the documents. What did they think, I was making the same mistakes like when they presided over the first miscarriages of justice?

Went to work all set with my stuff to celebrate Poppy Day with my colleagues & children. Prepared them for what was ahead & went out to get fresh air. I was in the garden when this little boy came out, walks towards me with his hand outstretched… Picking up the universal greeting when I saw the outstretched hand, I got down to his level & shook hands & asked his name.
He saw the football & started kicking the ball about, so I joined in his game because this is me getting the exercise to get rid of the bulges. I am telling U this child knows how to play football like a real pro? He was even trying to head the ball & he wont be 3yrs old until Jany. Suffice it to say he is from Syria, don’t speak a word of English & I don’t know a word of Arabic. But yet we were able to communicate via the Universal Languages of a Handshake & the Game of Football.
We went inside to observe the 2 minutes of Silence – Silence in Golden for Poppy Day. All the children done wonderfully well at this & I was more than pleased & acknowledged their contributions. Sad to say when it was time for my little Syrian to go, he got so upset as he wanted to continue riding the bike & play. We convinced him to come back 2moro.
Moments like these are the 1’s which make me want to get up, go to work, so I can reach 1 little child like the Syrian boy. He was such a little gentleman, until he had to leave nursery behind. Can’t help but think about the years I spent raising my 2 little Boys who are now Grown Men with their Own FAMILY? This only make me LOVE them even More & try to Cherish those times I spent with them nurturing them the way my PARENTS done b4 Me…! So this is dedicated to my Sons Kevin D. Murray & Valdin Legister who are my LIFE!

Here is the proof as supported by the Daily Express Columinst that “TECH don’t LIE. LEYF Nurseries have benefitted from my CPPDP from I started at Luton Street in April 2010-22.7.2014 when I transferred to BIB. Little did I know what was in store for me so soon after burying my #MOTHER. The Top Brass at LEYF Nurserieswere all in on the #Discrimination. I only survive because of the grace of God because He still have #Work for me to finish on this earth. Therefore my #FIGHT4JUSTICE campaign goes on to honour every #Man, #Woman, #Animal that have serve to give us the #FreedomofHumanRights.

Timely reminder of what LEYF Nurseries put me throw right after I got back from burying my #MOTHER. But thanks to Facebook, I have my #Journal with the #DefensivePractice I learned at the The Open University 2004-2010. As the Daily Express Columnist state “TECH don’t LIE”. Inspirations to set up my own website to showcase my #ContinuingPersonalProfessionalDevelopmentPlan. I will be using some of the collaborative working partnerships I have had over the years with other #OrganisationsinzSYSTEMS. Luckily I kept the records & adhere to #BritishEthicalGuidelines!

To all my friends, whether close or casual, just because. One of the longest posts I will ever write, and the most real too. Everyone will go through some hard times at some point. Life isn’t easy. Just something to think about. Did you know that people who are the strongest are usually the most sensitive? Did you know that people who exhibit the most kindness are the first to get mistreated? Did you know that the ones who take care of others all the time are usually the ones who need care the most? Did you know the three hardest things to say are I love you, I’m sorry, and help me? Sometimes just because a person looks happy, you have to look past their smile to see how much pain they may be in.To all my friends who are going through some issues right now–let’s start an intention avalanche. We all need positive intentions right now. If I don’t see your name, I’ll understand. May I ask my friends wherever you might be, to kindly copy and paste this status for one hour to give a moment of support to all of those who have family problems, health struggles, job issues, worries of any kind and just need to know that someone cares. Do it for all of us, for nobody is immune. I hope to see this on the walls of all my friends just for moral support. I know some will!!! I did it for a friend and you can too. Recorded my Song 4 Poppy Day – When Johnny Comes Marching Home Again…! Don’t even know where it comes from, but is assuming it has to do with a Man returning safely from the Wars? Not many were/are lucky to return or if they do are Maimed for Life. So today I remember men from JA like Rezzell aka Massy WELCH who fought in 1 of the Wars! I came to the UK to learn this fact when I saw him on Ground Force on BBC 1 when they done up the Soldiers Home in Mandeville. So today let me join in saluting all those who fought & is still fighting for our FREEDOM…! So Ms Heidi McGann aka Kim Welch this is in honour of Ur Grandpa!!! As soon as I have time I’ll upload?

Went to work all set with my stuff to celebrate Poppy Day with my colleagues & children. Prepared them for what was ahead & went out to get fresh air. I was in the garden when this little boy came out, walks towards me with his hand outstretched… Picking up the universal greeting when I saw the outstretched hand, I got down to his level & shook hands & asked his name.
He saw the football & started kicking the ball about, so I joined in his game because this is me getting the exercise to get rid of the bulges. I am telling U this child knows how to play football like a real pro? He was even trying to head the ball & he wont be 3yrs old until Jany. Suffice it to say he is from Syria, don’t speak a word of English & I don’t know a word of Arabic. But yet we were able to communicate via the Universal Languages of a Handshake & the Game of Football.
We went inside to observe the 2 minutes of Silence – Silence in Golden for Poppy Day. All the children done wonderfully well at this & I was more than pleased & acknowledged their contributions. Sad to say when it was time for my little Syrian to go, he got so upset as he wanted to continue riding the bike & play. We convinced him to come back 2moro.
Moments like these are the 1’s which make me want to get up, go to work, so I can reach 1 little child like the Syrian boy. He was such a little gentleman, until he had to leave nursery behind. Can’t help but think about the years I spent raising my 2 little Boys who are now Grown Men with their Own FAMILY? This only make me LOVE them even More & try to Cherish those times I spent with them nurturing them the way my PARENTS done b4 Me…! So this is dedicated to my Sons Kevin D. Murray & Valdin Legister who are my LIFE!

Walked thru the door & the phone rang… On the line 4 nearly an hour talking to my bredas Balis & Doston who gave me the low downs of the latest happenings in & around Townhead Westmoreland. The best part of the time spent on the phone was hearing Mama saying hello Ratty & responding that she is alright? Then I heard that melodious Laugh of hers & knew she is in good Spirits! Oh this was the icing on the most wonderful day that I had at work…! If only every day could turn out like this I would always be full of Laughs? 11.11.2013 is 1 glorious day indeed – Lest we Forget!

Fight4justice After EAT Modern Slavery

My Fight4justice the next phase 10th November 2018

To all those who have remain loyal and continue to be part of the #support_network that have given me the incentives to go on with my Fight4justice campaign. I am using this as a gesture of my appreciation for not giving up on me. I would like to let you know that I am moving away from https://www.facebook.com/public/Mervelee-Myers. Because Facebook is part of the terrorist cell, #exploiting me as a result of my vulnerability of having disabilities www.slam-iapt.nhs.uk/southwark. Over the past years from when Facebook gave LEYF Nurseries www.leyf.org.uk access to my account on the 18th September 2015, my life have changed forever.

I will therefore lay out the route of the discrimination that #blighted my prospects, #ruin my career and #destroy my life from the 23rd July 2014. First I must let you know that I was targeted before I left Luton Street. This was after coming back from Jamaica, when I said my final goodbye to my mother on the 22nd January 2014. Without realising that I was being radicalise, I was refused access to my FILE. I was reliably informed that this was with some solicitors, Bates Wells Braithwaite, www.bwbllp.com, trying to build a case against me. Sadly to say, I might have to accept this to be the fact, after reflections.

Without a shadow of a doubt this has to be the fact, for why the new manager #GemmaManns was treating me the way she did. And got others to join in, to the point where I had to seek support from the NHS Professionals. I was signed off work with #stress on the 2nd April 2014. Everything can be found in my Witness Statement to the Employment Tribunals https://www.gov.uk/…/ms-m-myers-v-london-early-years-founda…. And other publications to be found in cyberspace. That’s why despite the fact that I know I could not handle the stress of another ET, I could not accept the £58,000.00 NDA non-disclosure agreement offered.

My name is Lynne and I have been at Bird in Bush since 2001, taking over as Manager in 2013. We offer a bright and spacious environment which develops children’s confidence and social skills. We have a passionate team who give each child the personalised attention they need, and encourage the children to take an active role in planning activities. We work in partnership with parents and are a much loved part of the community – the building is from the 60s and many of our parents came here themselves! My favourite moments are seeing the children transition to school feeling confident and eager to learn! We’re very proud of our nursery and would love to show you around! We’re located in Peckham, providing care for children from 3 months to 5 years. We’re open 8am to 6pm, 51 weeks a year.

How many signed the NDAs – non-disclosure agreement? I was offered £58,000.00 to be a voiceless vulnerable. I spoke to my Mama’s sister Ms Connie, the only Survivor in this photo! She was so full of beans, chatting away about life with me! I told her I am writing a tribute to her for all she has done for my Family & Mama in particular! Ms Connie told me “I am so glad when Joyo Mertie Bernard was born…” Being an only Girl & having a brother who was my Mama’s favourite makes it easier to understand where Ms Connie is coming from…? This doesn’t mean Joyo was the favourite, but because she is the 1 who is around Ms Connie 24/7 these days! Our Family go way back & Joy & I share lots in common especially been born a month + apart! Yes I am the elder & Joy has more or less taken on some of the Caring Roles like my Mama in the Community>>> So lets join hands & heart & cherish our Elderly Folks with All they can have, until they are no more! Long may Ms Connie continue to enjoy good health, even thou she said she is getting weak! XXX U Ms C!

Is akin to the discrimination he faced when he was told by a Bank Manager “Mr Tomlinson, you have a small illusion that one day, you can become a Property Tycoon”.  I am challenging the www.justice.gov.uk/tribunals/employment-appeals/ that this is a hate crime and offensive. The UK government have effectively stripped me of my rights when I was delegated to living off www.direct.gov.uk/carerswww.direct.gov.uk/carers.  Then made me a voiceless vulnerable victim at http://www.universal-credit.service.gov.uk/journal/add-journal-entry-write-content/SERVICE_ISSUES/ after threatening to issue me with criminal records.

Facebook harvested my data, given www.leyf.org.uk access to my account from the 18th September 2015 when I was radicalised and my vulnerability of having disabilities used against me. The fact that I used Facebook as my confidante should be taken into consideration. In light of the adice from www.healthmanltd.com. Instead the Passive Aggressive Behaviours that were the strategies I applied so not to become another victim like my brother. Who was provoked and ended up in prison where he died was used to exploit my vulnerabilities. Now some racist offensive oaf by the name of Judge Shanks from LondonEAT@hmcts.gov.uk can tell me that I made up my disabilities. Why did they not take Facebook as reference, the same way I was judged for trying to protect myself and family from what happened to my brother? This is the last time I was with my #BredaBYRON at Coronation Market, Downtown. Little did I know this was the last time we were to be together like this. Probably, I might have done some things differently, I don’t know. 
BYRON died of #ColonCancer on the 27th March 2008. He died within #3Months of the 6 months he was given to live at #56yearsold.
A bright spark disappeared from our #Family, but his #Memories live on with me forever.
Today I remember my #Niece Sara-Kay as she will be celebrating her #Birthday in November!
Ms Connie Jourdine-LEGISTER was BYRON’S #GodMother & I am so privileged to have her to tell me the stories about #Mama & our #FAMILY that Mama was unable to tell us.
The #LEGISTERNEMBHARD links remain as strong as ever no matter what.

So when they tried to take my volunteering work with www.resourcesforautism.org.uk, I put them on hold about what they done to me in 2008, why I am part of Dr Maria Hudson Research Paper. They are responsible for ruining my career, because of jealousy.

For that racist offensive Judge Shanks from the Employment Appeals Tribunal to say I made up my disabilities is blashemy. He is actually denying that 92% of my DNA is African. I will have him and the Employment Tribunal idiots know that I am participant with www.heal-d.co.uk. There is no way the NHS is going to do anything for me. All the children & their parents & staff at Luton Street were a joy to work with. I worked at Luton Street LEYF Nurseries April 2010 – 22nd July 2014. The rot set in I am now reflecting after the manager Julie Weiss left & the new #BreedofStaff came in. It started going downhill from then. Of course I didn’t know then about the #InstitutionaliseCorporatePSYCHOPATHS that were taking over LEYF Nurseries?

I am still the #CleverPractitioner I have always been. Yet LEYF Nurseriesdeprived me of my #HumanRights. Now they are getting others to join them to #DISCRIMINATE against me. So the Agency Connex Education has not ever given me a placement. But they think they can clog up my emails with their same old #NonExistenceJobs everyday. Well I have given them prior warnings & if it don’t stop…? As for those others, I am thinking if they were threatened by LEYF Nurseries about not putting in any #FurnitureOrders? Because that’s the only reasons I can think for them to be behaving so #Unprofessional! U would not believe their #NOMADAncestors were given a rough ride by the #SYSTEMS!

When I got to BIB, the staff were afraid to celebrate #Christmas because #1MemberofStaff forbid them because #BenedicteSiewe said she celebrated #NOTHING. LEYF Nurseriessanction her to do as she wanted despite BIB was newly taken over. But that didn’t stop the #SimmplyMinded Benedicte from making sure she was the #FaceofFotos for LEYF Nurseries publicity campaigns/promotions. It takes all sorts to make up this world. The Wheat & Tears shall grow together until the day of harvest?

Oh the LEYF Nurseries that has developed into the #CorporatePSYCHOPATH would not know anything about the work I did promoting #MultigenerationalApproach like this. Because after working with them for #5years & presented with a #CEOLongServiceAward on the 15th October 2014, then the #DISCRIMINATION started at BIB. But stranger still the #CEO of LEYF Nurseries LIED & set out to entrap me on the 28.1.2015. That’s when the #Pennydropped & I realised how #DeadlyPisonous the #TopBrass in the Organisation were. Just think #BitterCassava! Then the 29.1.2015 #Trustee & 30.1.2015 Senior HR #SillyDilly visited. But now I am really sorry for that #PoorWoman because she too experienced #AgeDiscrimination?
I must make the effort to find out how the #ElderlyLady is doing, if she is still with us?

Parents Evening at Luton Street LEYF Nurseries. I taught them everything I know from my studies with the The Open University 2004-2010. Then when I got to BIB, I was supposed to #TrainStaff like I have been doing since I started working in the #EarlyYearsSector in the UK. But truth is stanger than fiction as I now have to ask their #Permission to do the work I trained them to do. My #Knowledge was always viewed as threats from I was at King’s College Hospital, where the rot started.

We need to examine #RACISM as it applies to the Equality Act 2010. Since I don’t have time to have a look at the Equality Act 2015-2016, I will have to find the time after cutting down LEYF Nurseries to size? This is me at Luton Street where I was the backbone implementing & promoting the EYFSWelfare Requirements, Ofsted Standards & the 5 Core Values along with taking on the roles of doing everything else that #MANAGEMENT didn’t have a clue about. Then #5years later I was reduced to a #JennySaville by none other than LEYF Nurseries & their #Cronies. That’s why there is my #FIGHT4JUSTICE campaign. I have moved on from where I am in need of #APPROVALS!

2day I salute Ms Audrey Hanson who was the Leader of the Townhead Primary School Cub Scout Movement! Distance have separated us, but I am eternally grateful for your wise wisdoms & guidance that U extended to my Children, in particular my #2 Son Valdin Legister whom U took under Ur wings! 2day I join hands & heart in saluting all the Teachers who came under the Umbrella of the Townhead Primary School Family, laying the Foundations for the Good & Great of the Generations from all over the Communities of Westmoreland! Names are too many to mentioned, but WE all know who our Teachers were & still is?

Hi Thelma this is just a little token of my appreciation for helping me out of my predicament on Thursday. I must first say thanks for your patience when I was overcome by my emotions and cried my eyes out. It was just one of those moments when I thought the world had turned its back on me and there was nowhere else for me to turn.
It is persons like you and Sean G the bloke who turned up late at night to collect my barrels who gave me the faith not to ever give up on Human Kind again. When I spoke to SG and was thanking him profusely for taking time out of his busy schedules to come and do me a favour, he suggested I should be thanking you instead. So I duly asked him for your name and can visualised a very professional person working in a busy work environment, especially at this time of the year. However you did take time out ensuring my needs were met when all doors seemed to have been closed.
I am truly appreciative of all the lengths you went through to help me out and I will forever be grateful for what you have done. I must also say how very mannerly SG conducted himself, even going to great lengths explaining that he would have called to let me know he was on his way, but he did not have a number and by that time you had left the office.
Keeping on doing what you do best Thelma and just remember there are folks like myself out here who are really appreciative of that extra mile that you go to in ensuring the public are given the best services. Once more I take my hat off to Thelma and Sean G from Kingsley’s Shipping Croydon who came to my rescue on Thursday.

Updates 28/10/2018: Facebook https://www.facebook.com is responsible for the terrorist cell they provided to LEYF from the time access was given to my account on the 18/9/2015. Facebook have since been using radicalisation and terrorism to close my account to stop me from telling my stories about the Modern Slavery Practices at LEYF. I have issued Facebook with a grievance, amongst other correspondences. Now all Facebook is doing is making sure my posts are not seen. Excepting sending my posts to me as advertising. I am slowly getting myself away from the devisive environment that Facebook has become. This is not good for my disabilities, mental and physical. I am not interested in any of Facebook offers.

I was given the opportunity to empower myself during the time I was privileged to work at Luton Street Community Nursery – LEYF. From April 2010 to 22/7/2014. My accolades, my appearance on http://skynews.com/, and publishing in the www.nurseryworld.co.uk are just some of my achievements during this time. That’s why I am using my talents, creativity and skills as a writer and photographer in sharing with the world how the ET, establishments and systems have been colluding to protect LEYF.

#MeTooFight4justice against Discrimination – #JudgeShanks of the Employment Appeals Tribunal.

Today I am writing about the discrimination at the Employment Tribunal Services and the Employment Tribunal Law at the EAT on the 19th October 2018 by Judge Shanks and Barrister #SamanthaJones. From my observations of the makeup of the panel, I am positive that discrimination is very much evident in the #tokenism represented in having a #blackman on the panel at this stage of the proceedings. I am of the opinion that they were rubbing salt into the wounds after my #Racism claim was strike out repeatedly by a #JudgeMartin. There were no diversity presented in the panel before. I am left with the feeling that the EAT was treating me as my fore parents were back in the days of the #MiddlePassage.

Despite the evidence provided that came from #JudgeBaron Preliminary Case Management Order of the 15/3/2016, the EAT take the stance that I did not have disabilities. Despite me raising concerns to the ET about #JohnFenton non-compliance of #JudgeElliott Case Management Order of the 8/6/2016, the ET failed to act. They then went on to make me a victim with the #reserve judgement copied from the Respondent Summary. After the advice from the Employment Lawyer from #PeckhamLawCentre, I provided the EAT with the Medical Report and another Impact Statement.

Subsequently the way the EAT treated me, holding unto my files is an indication of how they continue to use my vulnerability of having disabilities against me. Like what LEYF Nurseries done and the ET, the EAT used information about the impact of my disabilities when exacerbated and triggered in carrying out normal day to day activities (refer to the Equality Act, 2010 and Witness Statement).

The EAT
The Hearing was an indication of how the #Slaves were treated during the Middle Passage. What came out of it was the two (2) Panel. For me the white woman representing LEYF #oppressors starting with June O’Sullivan who sanction the discrimination. This was after returning from burying my Mother. The others terrorise me from I transferred to BIB, HOC and New Cross and ended up #resigning with a #nervousbreakdown. The black man representing those who sold my #ancestors into slavery.

This is represented in the way I was treated by #NeilKing, #RashidIqbal, #NeilBest and #CorneliusMeir of Darvell School, Community Playthings UK. I was invited to CO on the 22/9/2015, when Neil King tried bullying, harassing and intimidating me to write a resignation. Rashid Iqbal chaired the Disciplinary Panel and did not know about #BackraMassahs otherwise known as Slave Masters (refer to bundles). The others are John Fenton, #MartinBunch of Bates Wells Braithwaite. There was #MarkEssex of Voice: the union for education professionals, they still charging me fees three (3) years after I have not work. The Telephone #Conciliation Judge, the ET #JudgeMartin who strike out my Racism claim and #JudgeFreer and #MrDixon.

The Eugenics Debate
My elderly 95 years old husband was with me at the EAT, having to sit there listening to the insults that I made up my disabilities. When he came to the UK in 1956, an ambitious young man from Jamaica. Trying to make life for himself and his family, he was told by a bank manager. “Mr Tomlinson, you have a small illusion that one day, you can become a Property Tycoon”? Not much have changed in the United Kingdom since. They are using us to do the jobs, then turn around and make us victims like what the ET and EAT have done to me.

For Judge Shanks to say I make up my disabilities is worse than the Medical Models steep in Eugenics. My Medical Reports are with the ET & EAT. They were not used and Samantha Jones claimed they were not provided. Please go back to correspondences to John Fenton, copy to the ET. Then go to Dr Maria Hudson Research Paper 2012 for the Policy Studies Institute. Recommended to Acas. Judge Shanks is a #racists, #prejudicial #bigot who is using the power of his authority to protect LEYF that are operating Modern Slavery Practices. The question remains, what are the links between those involved in trying to make Mervelee Myers a voiceless vulnerable?

Saying my final goodbye to my mother

I, Ermine Mervelee Ionie Nembhard-Myers-Tomlinson aka Mervelee Ratty Nembhard Ratty is the sole author and publisher of this blog Merveleeconsultancy. I make no apologies for writing and publishing my blog at WordPress to uncover the discrimination happening in the Early Years Sector. In all honesty, I have given all those involved in plotting to destroy my life, the time to make amends. On reflections this started from the time I said my final goodbye to my mother, #PerlineLouise Nembhard on the 22nd January 2014 in Jamaica and returned to the United Kingdom. Attending my first LEYF Nurseries New Year Staff Party on the 23rd January 2014. Look carfully here that this is not tag because Facebook is working with LEYF and cohorts to terrorise me from the 18th September 2015. When access was given to my account in breach of the Data Protection Act. Since then https://www.facebook.com, have breached its own policies and procedures and the GDPR. Article 8 of the Human Rights Act protects the right to privacy. Now it is used to muzzle reporting. The law should protect the weak against the powerful. But instead its vice versa.

Now I have to tell you why I did not attend the NYSP before. This was as a result of what #MariaGoncalves and Maria Freeman done to me at Fitzrovia Community Nursery before I completed my #Probationary Period. The ill treatment triggered my childhood traumas and took me back to where I had my first nervous breakdown at Mapother House Day Nursery, King’s College Hospital Kings College Hospital NHS Foundation Trust. Considering I was the staff who encouraged my colleagues to sign up to go, I felt lost when #MariaFreeman visited on the date of the NYSP to interrogate me. By the time she was finished with me, I was a nervous wreck. There was no way I could attend.

I am only bringing this up because #HildaMiller bring it up at the Employment Tribunal, trying to make a mountain out of a molehill. Of course this is another of the protected characteristics in the Equality Act, 2010. If you read the Witnesses Statements, you will notice the #RacialProfiling. Most of the witnesses started working with #LEYF less than a year. There were others who I never work with and meet them on a single occasion or for trainings. I would like you to understand that up to the time of the ET, the contract I signed on the 7th October 2009, was not reviewed and updated.

Transferred to Luton Street Community Nursery

I was only transferred to Luton Street by the generosity of #JoelleLax, with whom I worked at my first job in the Early Years Sector, EYFS. She was on the Panel at the Disciplinary Hearing. I understand she is no longer working at LEYF. In the beginning, because some of the staff did not understand me, there were frictions. But in no time, I managed to get my colleagues on board as can be verified from the #accolades over the years. Yes I won’t tell anyone that there were no differences of opinions, but the Luton Street team was the best from across LEYF settings. We were crowned Nursery Team at the NYSP 2014. That’s why we were the beacon of inclusive practice to be on public in the media. On Wednesday 5th September 2011, Sky Newshttp://skynews.com/ done a broadcast from there. I will wrap up Luton Street by saying I was given the send-off of a life time at the graduation on the 22nd July 2014.

When the Rot Starts to Set in

I guess the rot started to set in, in 2013 as far as I am aware, now that I am reflecting on the events leading up to my own problems. There were changes as LEYF set about to becoming the biggest in the Early Years Sector. I am not sure what Ofsted thought of this, but nothing suprises me anymore. They were Nursery World Magazine, Nursery Chain of the Year 2014. The same time I was given the CEO Long Service Awards. They have cohorts in high places, to cover up their discrimination and #PhillipGreenstyle behaviours. People were losing their jobs, starting with the #chefs. Then one day there was the announcement that Karen Walker, Head of Children Services and Families resigned on the spot.

There were speculations that it had to do with the fact that June O’Sullivan and Karen Walker did not see eye to eye. #Dearbhala was acting in the post after Karen resigned. But surprises, she did not get the post. It was given to #RashidIqbal who I meet at the NYSP. I will end by saying Rashid Iqbal was one (1) of the seven (7) witnesses at the ET. But at the time he had already #resigned his job. Don’t know if was pushed, or if he jumped. I understand that Hilda Miller resigned after the ET ended. #NeilKing I learned he resigned when the documents were exchanged. So why have all these high profile employees resigned and leave the #tyrantJuneO?

Dearbhala left to go back to Ireland. #JulieWeise left the company and there were changes going on that caused the uncertainty that led to LEYF left in the situation that #JyotiSharma_Bhardwaj and others write about on www.leyf.org.uk. After coming back from Jamaica in January 2014, I began to notice the subtle changes going at Luton Street. I was stripped of my statuses as EYFS Coordinator, SENCO and Multigenerational Working Approach Facilitator, but still doing the job. By the time they started treating me unfairly, I had to go to the GP to get support and was signed off with stress on the 2/4/2014. I have had counselling at the Maudsley Hospital.

Death of my mother

After coming back from Jamaica after saying my final goodbye, I was experiencing personal problems. By the 2/6/2014, my mother was dead. Anyone can access my stories on social media as I chose to make my life an Open Book. That’s why I refuse to let Facebook https://www.facebook.comdictate my life and benefit from my misery. I returned after burying my mother and was granted my transfer to BIB. I am on YouTube, at LinkedIn, Flickr, at Tumblr, Instagram, at Twitter, et al.

The Employment Tribunal Sagas

My life from the time I transferred to BIB, HOC and New Cross is all over social media platforms. Therefore I will leave you to do your own research and come to your own decisions. But I am writing this as the prelude to giving others the opportunity to come forward to telling your stories about LEYF. Because after that I will be naming you from my defensive practice.

June O’Sullivan I am throwing down the #gauntlet to you, naming you as the Phillip Green of the Early Years Sector. I was offered £58,000.00 during the Telephone Conciliation. I refused to accept it when the Judge was so rude telling me that LEYF have to #protect themselves from me. I am guessing this was going to be non-disclosure agreements. NDAs are legally binding documents designed to keep information secret, curtsey of the Daily Express Nick Tsatsas Employment lawyer Keystone Law .

But knowing that there were already information in the public domain, I refuse to accept. Maybe now I will have to find out who is the recipient of that amount of money. Could this be #JohnFenton of www.personnelconsultancy.com or even #MartinBunch of Bates Wells Braithwaite www.bwbllp.com? Or even Voice: the union for education professionals. Or employers from the Employment Appeals Tribunal or ACAS.

Mervelee Ratty Nembhard This is my Fight4justice after the ordeals of the Employment Appeals Tribunal on the 19th October 2018, left me in servere difficulties. Coping with my disabilities is no easy feat. As for that #JudgeShanks denigrating me about making up my disabilities, today is my father’s 100th DOB. Here is my other uncle who also had Parkinson’s. Look carefully at the photo to see my grandmother who lived 10 years after my father. She was at my uncle’s wedding. Now if the Employment Tribunal want to know more go back and look at my bundle and witness statement. Some of you lot are a disgrace to the Legal Entity that you representing. The same way the Department for Work and Pensions – DWP and Metropolitan Police Service are. As for that Winsome Duncan: Author, Artist & Book Confidence Coach, I hope she get knocked out by a duppy on her 41st birthday!
