As a member of the Resident Panel, Mervelee Myers is exercising my rights as a vulnerable person who has been let down by the Housing Ombudsman Services and Mr. Richard Blakeway in particular to the point where after attending Court on Wednesday 18th September 2024, I came away feeling SUICIDAL. After leaving Court I attended my appointment with Dennis Kamara and was in time to hear him talking with a female on the phone. The purpose of the talk was Dennis was arranging support for me with Mental Health Older Adults Service 02032286920. After leaving the appointment I had to take my “Marriage Certificate” to the Job Centre to get it scanned to send off to get Bereavement Support Payment. I visited a friend of mine and was too SCARED to come back to my home where I no longer feel SAFE. I sleep on his sofa and leave early next morning. I have not eaten a proper meal in days and having DIABETES does not help my situation. I had to call the Police again when my neighbour started shouting abuse at me and threatening to come down to SORT me out. CAD 7435/16SEP24 and I have an appointment to be interviewed on the 22/09/2024. I have been living like a PRISONER at Alma Grove London SE1 5PY since I was forced to barricade myself in on Christmas eve 2022 for over an hour. The Safer Neighbourhood Team was supposed to contact me from then, am still waiting. Let me share more recent information about my engagement with the Metropolitan Police that will expose “A New Met for London” as a cover for GASLIGHTING and MISOGYNY in breach of the Equality Act 2010 Protected Characteristics in the UK in 2024. To 2024 when my husband was neglected on BYRON ward and on the 6th April 2024 after attending the Windrush Vigil in Brixton Nurse Betty called Security I was ABUSING STAFF. I was removed from my husband’s bedside and ended in A&E at St Thomas’ Hospital. I never saw my husband again until he died on the 8th and they waited 6 hours to inform me. Since LEYF CEO sanctions the DISCRIMINATION and labels me Unprofessional, Uncoorporative, Rude, Intimidating, Confrontational, Aggressive – Lacking Empathy (UURICA-LE) after I fronted OFSTED at BIB in September 2014 and was given the CEO Long Service Award. Let me put the Government in the spotlight. In 2011 I meet Michael Gove at LEYF Annual Conference. I represented LEYF at a Consultation with the Communities Secretary Eric Pickles. I will end by saying it is a dying shame on the Housing Ombudsman Service to be operating like WOLVES in SHEEP clothing whilst Housing for Women tenants like Ms. Presley and Mervelee Myers are GAG with threats of IMPRISONMENT and EVICTION via CONTEMPT of COURT because H4W employ Devonshires Solicitors LLP to send me letter of repossession in July 2023. I want the HOS to go track my online RECORD of seeking help. I even contacted my MP Neil Coyle who has been in touch with H4W. I am sat in doors hoping they will come and fix the toilet seat again, before my visitor arrives from abroad. I told the person I have spoken to I don’t want my vistor to come see me in the state am in.

I have an appointment for an interview next Friday, I got up feeling SUICIDAL. The person at CRISIS 08007312864 Victor has only made matters worse. As an EYFS coordinator SENCO and Multigenerational Working Approach Facilitator at LEYF, I will take back control and let the world know how the person who was the face of “Windrush 70” is being treated in the UK after the contributions I made.

Mrs Mervelee Myers v Devonshires Solicitors (the “Claim”).

Mervelee Myers respond to put Devonshires Solicitors LLP that I am aware of the proceedings and trying to keep up.

The Claim

Let me begin by starting with the letter that was sent from Devonshires Solicitors LLP Narin Masera in July 2023 after Housing for Women letter about mediation came after the date, I was supposed to contact them about the mediation. Before receiving the letter from Narin Masera about possession, I had no knowledge about Devonshires Solicitors LLP.

Without Prejudice as a Lay Person who has been forced to represent myself from the first time, I experienced “Systemic Discrimination” after the death of my brother with “Colon Cancer” I will use the “Equality Act 2010 Protected Characteristics” to address this claim.

Improper use of the Pilot

I will repeat as a “Lay Person” I have to rely on myself to get justice from the Injustices because I was a participant in Dr. Maria Hudson’s research paper “The Experience of Multiple Discrimination” for the Policy Studies Institute recommended to ACAS. Please refer to the BUNDLE of K02CL827 at page 320 for a sample of an email from rattynem@btinternet.com to Maria Hudson, Policy Studies Institute, 50 Hanson Street, London W1W 6UP. Therefore, I will ask Devonshires Solicitors LLP like what I did when I called Narin Masera on the day I was taking him to look about the “Power of Attorney” with Mimi Owusu who introduced us to Amphlett Lissimore Solicitors Greystoke House, 80-86 Westow Street, London SE19 3AF. I called in good faith the number that was on the letter, hoping to make Devonshires Solicitors LLP aware of the reputation of h4W.

I will repeat I spent the past 10 years trying to get my life back on track. For Devonshires Solicitors LLP to join H4W in breaching the Equality Act 2010 Protected Characteristics by the GASLIGHTING and MISOGYNY must be highlighted.

All I can say on this matter is I have used the CCMCC before making claims and faced more miscarriages of justice. Hence I know the names of some of the District Judges involved in this case. For example, DJ Sterlini who labelled me a “VIOLENT NUISANCE” on Emancipation Day 2023 strike out my claims with Winsome Duncan after it reached “Telephone Conciliation”. DJ Bell who requested for me to do the “Psychiatric Assessment” sent 7 of my claims from County Court at Clerkenwell and Shoreditch to Central London County Court including Barrister Ryan Clement that judgement was passed for him to pay the £9455.00. I am still waiting to be paid, but 4 years after Court Enforcement failed to collect my money. They are sending me threats…

Here again is proof of how Mervelee Myers is the victim of the Judiciary of England and Wales, the Criminal Justice System and the Crown Prosecution Service when unscrupulous Devonshires Solicitors LLP decide to use Mervelee Myers VULNERABILITY against me.

Lack of Merits of the Claim

As a person with “Mental and Physical Impairments” whose stories are documented online before Devonshires Solicitors LLP got HMCTS to gag me with threats of IMPRISONMENT and EVICTION via Contempt of Court, I give up my rights in order that I don’t become a victim like Nelson Mandela who was made a CRIMINAL for his thoughts and ideas. Your Client knows well what they are doing to tenants. So does the Housing Ombudsman Service Richard Blakeway. For Clarity may I advice you to look at the BUNDLE pages 217-228 of Mimi Owusu’s “Witness Statement.

Mervelee Myers will not argue about what the Court has done. Because we will have to go back to https://www.gov.uk/employment-tribunal-decisions/ms-m-myers-v-london-early-years-foundation/2300047-2016 for why HMCTS and CPS and CJS will not tie me up in knots to cover the miscarriages of justice from Kings College Hospital NHS Foundation Trust for why my 101 year old husband ARNOLD EBENEZER TOMLINSON was neglected on BYRON ward. And Nurse Betty called WHITE SECURITY to remove me from his bedside on the 6^th April 2024 after I attended the Windrush Vigil. For your information Trina Philbert provoked me on the 4^th April 2024 after the HEARING. Some of the posters were that of the Rev Rose Hudson-Wilkin the first Female Bishop of the COE whose grandmother and my mother were related. I had poster of Jessie Lloyd an Australian Aborigine who Mr. Tony Cealy introduce me to and I am listed as the COMPOSER for Border Crossings SONGSTREET App.

I was not the one engaging in any such behaviours by the way. I refuse to engage with the MALICIOUS arguments you have decided to put on paper. Instead ask your client to stop the coercive control of Deborah Agnes Gilchrist to target me. Please get her the help she needs to stop doing to me all listed above and more.

I have another Reference 2024000031 representing the 23 years of HATE CRIMES against me and how I managed to live with an ALCOHOLIC who spent time in prison for DRUNK DRIVING. I refuse from breaching the INJUNCTION so am IMPRISONED and EVICTED before I get to submit the RESEARCH FINDINGS about Housing for Women and Devonshires Solicitors LLP plots. The plots with the Judiciary of England and Wales and Criminal Justice System and Crown Prosecution Services with the continuing MISCARRIAGES of JUSTICE. I will ask the Solicitors and Barristter to use Subject Access Request to get the DATA that H4W wiped from the Customer Portal. In response to your request for a letter with more information, please see below. I am a GP working
at the surgery Mervelee is registered at. Please note that my previous clinical interaction with
Mervelee consists of 3x 10minute consultations since 2017. Please note that time allocated by the
surgery for completion of this letter was 20minutes, so I am note able to be as thorough as I would
have liked, and I am also not sure that I am going to be able to add much to the thorough
psychiatric report that was completed in April.
You ask for specific mental health conditions – she was diagnosed with anxiety and depression
several years ago (first coded in 2018). There was a query of bipolar disorder made by my
colleague Dr Evans due to paranoid behaviour, pressure of speech, labile mood (please note formal
bipolar disorder diagnoses are not generally made by GPs, this is something our psychiatry
colleagues do). A CMHT referral was done but rejected, they asked she see the mental health
nurse first but it appeared this never happened, although she does now have an appointment at the
end of August with the mental health nurse at the surgery – if the nurse feels CMHT input is needed
she may then do a re-referral. Of note, CMHT did assess her in 2022 and found no evidence of
bipolar disorder or psychosis. Mervelee also reports that she has an eating disorder (Describes
some days she cannot eat or drink anything at all), although I cannot find evidence of a formal
psychiatric diagnosis of eating disorder.
You mentioned ‘disability issues’ – I am not quite sure what you are asking? She has a past medical
history of type 2 diabetes and knee osteoarthritis, although I cannot see any recent documention on
how the arthritis is affected her. There are no documented complications of her diabetes, it is well
controlled.

The Claimant made an application for an injunction under section 1 of the Anti-Social Behaviour
Crime and Policing Act 2014 on 24 June 2023.
An injunction order was granted to the Claimant on 01 August 2023. Following repeat breaches of
the injunction order, the Claimant made a committal application for contempt of court.
The committal hearing under claim number K02CL827 took place at Clerkenwell and Shoreditch County
Court on 12 June 2024 before District Judge Beecham. The Defendant attended and admitted all six
allegations in the contempt application, thereby confirming breach of the injunction order dated
01 August 2023. The order was as follows:
a. Penalty for committal is to be reserved to DJ Beecham, to 18 September 2024 at LOAM, with a
time estimate of 2 hours.
b. The injunction order dated 01.08.2023 is extended on the same terms to the final determination
of the penalty on the committal application or further order.
c. Personal service of this order is dispensed with, the Defendant having been in court and
having been informed that the injunction would be extended.
As the sentencing hearing is on 18 September 2024, the Injunction Order is currently due to
expire then.

I, Duvaraka Balachandran of Devonshires Solicitors LLP (“Devonshires”) STATE ON OATH:

I am employed as a Paralegal at Devonshires who are instructed on behalf of the
Claimant in respect of these proceedings.
Insofar as the matters deposed herein are within my own knowledge, they are true.

I make this affidavit as the Defendant continues to engage in anti-social behaviour in

Committal hearing
On 09 July 2024, a hearing was listed before District Judge Beecham, whereby the
Defendant admitted to all the allegations in the Claimant’s contempt application. In light
of this, an order was made on the following terms:
a. Penalty for committal is to be reserved to DJ Beecham, to 18 September 2024
at 1OAM, with a time estimate of 2 hours.
b. The injunction order dated 01.08.2023 is extended on the same terms to the
final determination of the penalty on the committal application or further order.

Breach of Injunction Order

On 30 August 2024, our Marketing Manager at Devonshires highlighted that the
Defendant had again posted a blog referring to my colleague Narin Masera,
Devonshires and the Claimant, in breach of her Injunction Order. A link to the blog was
sent to our Marketing Manager via PR firm who track the blog for Devonshires. The
blog appeared to have been posted online on 30 August 2024 and as at the date of
the signing of this affidavit, is still online. There is now shown to me on page 1 -20
of Exhibit “DB1” a true copy of a marked up pdf version of the online blog dated
30 August 2024 and showing all breaches of the injunction dated 01 August
2023.
On 12 September 2024, I was notified by our Marketing Manager that the Defendant
had posted the following this week on social media platform “X” (formally known as
“Twitter”), in breach of the injunction order dated 01 August 2023:

I met with Ms Myers in clinic at Marina House today alongside her allocated care coordinator, Hawa Oweh (CPN).

Background

Ms Myers is a 65-year-old female, not previously known to the Southwark Older Adult CMHT, however previously under working age mental health services. Ms Myers was referred to our team by Dennis Kamara, a mental health nurse in primary care. He requested for an assessment of diagnosis and treatment options, with information that Ms Myers has a long history of low mood and anxiety with some previous underlying trauma and recent stressors including her housing association taking her to court and ongoing disputes with her neighbours.

The following information about Ms Myers’s mental health background is taken from available electronic mental health records.

Ms Myers’ mental health records date back to 2017 where there is a Merlin report from police with concern about Ms Myers struggling with her mental health following a tribunal, with also a mention of her receiving previous support from the Maudsley. This however doesn’t appear to have been followed by input from secondary mental health care. In 2021 there are a number of contacts with the crisis line and referrals to CMHT (working age), outlining concerns about low mood, anxiety and suicidal thoughts for the past 7 years since her mother passed away. Other contributory factors noted included the death of a neighbour the previous year and being charged with criminal damage and attending court in April 2021. Ms Myers had also spoken about the death of her brother and developing depression and an eating disorder as a result of discrimination at work. Another referral to CMHT in 2021 reportedly from Southwark council outlined concerns of Ms Myers feeling police were being sent to kill her. There was also a phone call from a mental health practitioner from the University of East London (student wellbeing service) expressing concerns about Ms Myers’ mental health and possible bizarre and paranoid behaviour.

In 2022 Ms Myers was assessed following a GP referral by the Southwark Assessment & Liaison Team. This assessment noted mental health difficulties appearing to commence in 2014 when Ms Myers was reportedly persecuted in her place of work, having worked as an early year’s practitioner. It was reported that Ms Myers was being accused by her nursery in Southwark of being ‘uncooperative, rude and confrontational’, and was under investigation, and then left due to ill health. Following this, she received 12 sessions of Cognitive Behavioural Therapy (CBT) at the Maudsley. Following this, Ms Myers had reported not being able to gain paid employment, but had worked voluntarily in mental health research, been involved in various organisations and online podcasts, and was also featured in a book about Windrush. Ms Myers had reported an incident of the police in 2021 attending her home and beating her, and that she now has a criminal record and has been turned down for jobs due to her criminal record check (CRB). She had reported feeling she has been targeted by certain people she used to work with and there was a pattern. The impression of this review was that there was not any clear evidence of depression or psychosis, that past events have been very stressful and that Ms Myers could benefit from further talking therapy. She was then referred to IAPT.

In 2023 and going into 2024 there were a number of referrals to CMHT, due to concerns about Ms Myers’ mental health. There was reference of Ms Myers’ housing association seeking legal action due to antisocial behaviour. In December 2023 Ms Myers was reported to have called 111 herself reporting feeling hopeless about the threat of eviction from her home and having ongoing issues with her neighbours. In March 2023 Ms Myers was brought to A&E by the London Ambulance Service reporting worsening mental health. No evidence of thought disorder or psychosis observed and GP was advised to review Ms Myers and consider a referral to mental health services.

In September 2024 Ms Myers was referred to the Southwark Older Adult CMHT by Dennis Kamara, mental health nurse in primary care. There were concerns related to her behaviour and posting references to suicide in her social media. Ms Myers was seen by Dennis in primary care alongside her son Kevin who had travelled from Jamaica where he lives. There were reported issues with housing, neighbours and family. She has lived in her current address for 23 years and has been having issues with neighbours banging her door and making malicious complaints about her to the police. The housing association has reportedly taken an injunction against her and she is at risk of eviction and the case is currently in court. Her son had reported the reason for this being Ms Myers putting up inappropriate material online about the council and refusing to take it down. Her son had mentioned Ms Myers storing urine for months to throw it at her employer’s property and putting up comments on social media about feeling suicidal, which Ms Myers admitted to, however, stated she would never do this due to her Christian faith. There was also concern from Ms Myers about a camera being placed in the shared communal doorway by her neighbours, that it initially faced towards the street however now has been turned directly at her. She had reportedly denied feeling the neighbours watch her when she is in her flat however, the only issue is when she is coming through the communal front door.

Recent progress

Ms Myers was initially assessed by our team on 08/10/24 at home by Joseph Mukuba, Community Psychiatric Nurse. Following this, I decided to assess Ms Myers myself to help come to a psychiatric diagnosis and consider treatment options.

I have subsequently reviewed Ms Myers in clinic on 16/10/24. During this assessment Ms Myers described to me in detail her background history to date, including the trauma in her upbringing (physical abuse from mother, father dying when she was a young age), and her first marriage to a controlling husband resulting in domestic violence. Ms Myers talked about losing her mother 10 years ago, and around the same time being forced out of working as a nursery nurse and following this receiving therapy. Ms Myers talked about the issues with her neighbours persecuting her, which have worsened over the years, and her recent bereavement of her husband a few months ago.

On 23/10/24 Ms Myers contacted 111 and LAS due to feeling in ‘crisis’ after her grandniece left having stayed with her without saying goodbye. I visited Ms Myers at home on the 25/10/24. During this visit, Ms Myers described in more detail the persecution she reports experiencing from her neighbours, whom she believes are trying to kill her, leading to her feeling unsafe at home. She reported since her husband passed away, she has been more careful in locking her front door and that if she didn’t do that ‘I would be dead’. Ms Myers showed me the doorbell camera her neighbour set up on the outside of the shared front door, and how she believes the neighbour is using this to monitor her coming in and out of her home. Ms Myers talked about her neighbour kicking on her front door every day to provoke her and her belief that her neighbours want to try to provoke her into confronting them, which would then give them an excuse to harm and kill her. Ms Myers has explained to me how she believes other neighbours are also siding against her and that she also feels under threat from the police and housing association, all working together against her.

On review

I summarised the purpose of review to complete the assessment following the referral to our team from Dennis Kamara, primary care mental health nurse.

I asked Ms Myers how she has been since we last met. She talked about the housing association not coming yet to fix her toilet seat, as well as the mould on her kitchen door and the damp in her windowsill. She reported attending her drumming group and doing a performance and spoke positively about this. She brought up about her neighbours continuing to try to provoke her since we last met. Ms Myers spoke about the neighbours ‘stomping’ on the floor loudly to provoke her. Ms Myers agreed that she believed the neighbours were trying to kill her. I recalled her previous statement to me that she believed the neighbours were trying to provoke her so that she would in turn confront them, and this would give them the excuse to try to kill her. Ms Myers accepted this is what she believed. She stated she would not attack them herself and is trying to keep to herself. Ms Myers said recently she stayed at a friend’s house overnight as she didn’t feel safe to return home. I asked about the camera. Ms Myers continued to report that she believed the camera on the doorbell was there to monitor her movements. She said she is trying not to think about this. She stated being more frustrated about her doorbell always being rung.

Ms Myers made a statement about never wanting to ‘give up’. I enquired about whether she experiences suicidal thoughts. Ms Myers stated this has been misconstrued and referenced a poster or piece of literature she was pictured in, that had the quote about people being unemployed, being at risk of suicide, and said this quote was then attached to her. Ms Myers did admit to having last had a suicidal thought in August this year, when her son was visiting her and she talked about her door being kicked. She didn’t report having experienced any plans or intent to act on this. Ms Myers stated there was no chance that she would come to harm via her own means. She has previously stated her Christian faith as a protective factor.

I summarised to Ms Myers what she had explained to me over the last 3 meetings leading to my opinion about her mental health diagnosis. This included Ms Myers’ description of her earlier life and trauma she experienced, the domestic violence in her first marriage which led to her separating and being saved by the housing situation, the loss of her mother 10 years ago around the same time as stopping working as a nursery nurse. Then over recent years with the increasingly difficult situation with her neighbours, beliefs that they are provoking her by monitoring her movements, trying to kill her and banging on her door, leading to her receiving a possession order which may potentially result in her being evicted and a possible custodial sentence due to being in contempt of court. Then more recently the stress of losing her husband. I explained to Ms Myers my impression that as a result of the build up of stress over these years that her beliefs and experiences about the neighbours could be explained by her being unwell with paranoia and psychosis. I explained that this is a condition that we could provide treatment for, including both antipsychotic medication, and psychosocial support, including psychology for psychosis. Ms Myers said in response to this that she had experienced some paranoia in the past. She said she accepted this was my explanation of opinion about her mental health. Ms Myers said she was willing to try medication if it would help. Ms Myers explained she had recently been to her new GP for vaccinations and blood tests, I advised I would check the results of these and then give her a call next week to see whether she would like to go ahead with starting antipsychotic medication. She agreed to this and accepted a patient information leaflet about risperidone. She confirmed having our contact numbers in case needing to get in touch in between appointments. Hawa confirmed she would make an appointment with Ms Myers when she had started on her medication to monitor how she is doing. We also discussed social activities and community groups, Ms Myers knew of Time & Talents and didn’t want to attend there, however appeared keener in Blackfriars.

Mental state examination

Ms Myers presented on time, she was well kempt, wearing a diabetes charity t-shirt, engaged well, reasonable rapport established, maintained eye contact, speech slightly pressured however, interruptible and voice not raised, mood reported as well and objectively appeared euthymic with reactive affect. Mild thought disorder evident with circumstantial responses. Describing persecutory delusional thoughts about neighbours trying to kill her and monitoring her movements. No reported auditory hallucinations and didn’t appear to be responding to unseen stimuli. Appeared well orientated to time and place. Insight partial however took on board opinion about diagnosis and agreed to consider treatment options explained.

Care Plan

I have provided written information for Ms Myers for an antipsychotic medication – risperidone. I advised I will check Ms Myer’s most recent blood tests with her GP and call her following this to see whether she would like to start risperidone or not.
I will send this assessment letter to Mrs Myers, and she is then able to share this with her solicitor for her current court case.
Ms Myers is assigned a care coordinator in our team – Hawa Oweh, CPN – who will monitor Ms Myers’ mental state and risks and support with psychosocial interventions.
Hawa Oweh has agreed to make contact with the housing association to support Ms Myers with fixing her toilet seat and other house matters needing repair.
Ms Myers confirmed having contact numbers for people to call, including the Samaritans, our team number during working hours (0203 228 2240) and the SLAM crisis line out of hours (0800 731 2864).

I am writing as a competent woman, to formally address significant concerns regarding a report dated 01-11-2024, attributed to you or produced using your electronic signature. This report contains inaccuracies, omissions, and potential defamatory statements, all of which appear to have been made without lawful authority, and I do not consent.

Serious Breaches Identified

Inaccurate and Misleading Content:
The report includes references to proceedings that allegedly affect me but omits critical details of my vulnerability as a grieving pensioner following the recent death of my lifelong companion. This oversight represents a failure of your duty of care, particularly when engaging with a vulnerable individual.

A copy of your qualification certificate, photo ID, and indemnity insurance certificate, confirming coverage of at least £5,000,000 for negligence, malpractice, or fraud.

Legal Implications of Non-Compliance

Failure to provide the requested documentation will be interpreted as implied admission of wrongdoing, and the contents of your report may be used as evidence in any subsequent legal proceedings. REPORT FOR TIME SPENT IN ENGLAND.

Arrived in England on June 4th, 2024, accompanied by my brother. We should have arrived in May to attend the funeral service for Arnold Tomlinson, deceased husband of our mother.

We stayed with our mother for the duration of our visit. My brother spent 2 weeks, due to work obligations and I was able to spend 3 months.

· During our visit, we made aware of of events that were certainly having a negative impact on our mother. We were made aware;

· court case between our mother and HAW – Housing Authority for Women.

· Conflict between our mother and her neighbors.

· Conflict with the police and our mother.

· Conflicts involving other persons and our mother.

The court case involved the possibilities of eviction and imprisonment. We were fortunate to attend the court case and got some positive news that there was a change of heart; the imprisonment and eviction were put on hold.

We witnessed the arguments between our mother and the neighbors a couple of times. During my duration, the police arrived at least 2 times. I was interviewed by the police on 2 occasions.

We had a few arguments and disagreements of our own due to our differences in opinions on a few matters, to include the behavior and mindset of our mother.

I must add that on my leaving England, in my opinion, my mom a was in a better frame of mind than when I arrived.

Just to add that, we encountered some issues with the apartment that resulted in discomfort. There was a broken toilet that was addressed. A leak in the bathroom that was also rectified. The water in the kitchen sink was draining extremely slow and this affected us severely. This situation lasted in excess of a month.

How it works

Verification technology: To get this additional disclosure, creators must use specific technology (certain cameras, software, or mobile apps) that attaches secure metadata to the piece of content. This metadata verifies the video’s origin and whether or not its audio and visuals have been altered.
C2PA standards: This technology is based on an open standard for content origin and authenticity developed by the Coalition for Content Provenance and Authenticity (C2PA). This standard allows users ways to understand the authenticity and origin of different types of media like images, videos, and audio.

How to get ‘Captured with a camera’ disclosure

For “captured with a camera” to appear in the expanded description, creators must use tools with built-in C2PA support (version 2.1 or higher) to capture their videos. This allows the tools to add special information, metadata, to the video file, confirming its authenticity. YouTube will relay the information that the content was “Captured with a camera,” and apply the disclosure when it detects this metadata. The content must also not have edits to sound or visuals. This disclosure indicates that the content was captured using a camera or other recording device with no edits to sounds or visuals.

What edits to avoid

To ensure the “Captured with a camera” can be applied, avoid these types of edits:

Edits that break the chain of provenance, or make it impossible to trace the video back to its original source. For example, if you capture an image with C2PA metadata and then save it to your phone’s photo album that doesn’t support C2PA v2.1 or higher, that may break the chain of provenance.
Significant alterations to the video’s core nature or content, including its sounds or visuals.
Edits that make the video incompatible with C2PA standards (version 2.1 and above).

Limitations

“Captured with a camera” only appears if a creator opts to use C2PA technology during filming. If it’s missing, it doesn’t mean the content has modified audio or visuals.

Note: This feature is separate from our existing altered and synthetic disclosures.

The metadata that leads to a “Captured with a camera” disclosure is made by a 3rd party (for example, a camera manufacturer). This means there is some risk that someone could take a photo of another screen showing synthetic content. Because the other screen shows an image that has been modified, it wouldn’t be eligible for the “Captured with a camera” disclosure. This issue is called “air-gapping.” Camera manufacturers will continue to develop detection measures to prevent “air-gapping,” but the sophistication of those detection measures may vary in the near term.

Good day Mr Solicitor

After reading your response to my concerns raised and the letter dated 18 December 2024 from the Court and reflecting on events from Boxing Day when I was in my garden, I came up with this conclusion. I will share this to back up my arguments about the continuing DISCRIMINATION.

And the reasons Dr Phil Gregory was brought on board to entrap me with RESPIREDONE to SILENCE me.

There are inconsistencies in the letter dated 18 December 2024 making no mention about the EVACUATED cases. Instead, I was sent a long list for a trial on the 7 March 2025. However, the response from the Solicitors states the trial is due for the 10 March 2025. Because I have been passing on information to the Solicitors and nothing is done to add them to my arguments.

The DEFENDANT has permission to file and serve any updating evidence in response 14 days before the trial. Here is my UPDATED EVIDENCE in REVERSE.

1. CAD 2358/03Jany25 I was visited at home by 2924AS and 2499AS evidence online at YouTube.

2. The patterns of DISCRIMINATION by my Neighbour who is supported by Housing for Women and the Metropolitan Police must be taken into EVIDENCE from the time Met Police was sent to SECTION me from a malicious report I wrote on Facebook I was feeling SUICIDAL.

3. Between 30^th October 2021 and 3^rd January 2025 must be taken into evidence. Because it was DJ Sterlini who strike out my claims with Winsome Duncan after “Telephone Mediation” who labelled me a “Violent Nuisance” without me knowing about the ORDER.

4. I was provoked when I looked out my window on 3rd January 2025 and evidence of Ms Gilchrist and Barbara McCoy’s HATE CRIMES can be verified online. Mention was made about the INJUNCTION and obviously my Neighbour was fed information about the outcome of the EVACUATED cases. Whilst I was left in the dark, because the Solicitor did not inform me and there was no mention made in the letter dated 18 December 2024 that I got on Christmas eve.

5. The actions of the Met Police Officers above can be verified online.

6. The actions of Joe Hooper kicking my door has not been dealt with. Refer to CAD 6326/03Jany25 and CAD 5227/03Jany25 and CAD 3020/03Jany25 and CAD 2824/03Jany25 and CAD 2052/21Dec2024 to get an understanding of how I am treated by the Met Police.

7. I was DEPRESSED during the Festive Season because I suffer with SAD and the fact I am excluded does not help. I am living at Alma Grove like a prisoner. I am a DISABLED NHS Pensioner without a GP.

8. I was in the kitchen cooking when I noticed my Husband’s Angel Trumpet flowering, so I went out to capture the BLOOMS in his memory. I could hear a dog barking and then I heard my name called MYERS. I responded by asking Ms Gilchrist if she was talking to me, she began her TIRADE. This can be evidence from the recordings. When I realised Ms Gilchrist was videoing me, I asked why she was doing it. She responded she needs it for her DEFENCE.

9. I returned to my kitchen because I decided I will not let Ms Gilchrist provoke me to return to the DARK PLACES I am coming from over the past 10 years.

10. The PROVOCATIONS continued that I only feel safe when I bolted the door.

11. Some days I don’t open my curtains and if I do so and look through the window I will get VERBALLY ABUSED from across the street.

12. I received a letter about an appointment on the 19 December 2024 which I did not receive. This is patterns of GASLIGHTING and MISOGYNY to make Dr Phil Gregory’s Medical Gaslighting Report Factual that EVERYTHING am saying is in my HEAD.

8. I was made an INACTIVE PATIENT by Silverlock Medical Centre on 5 December 2024.

9. I received THREATENING LETTERS after raising concerns about Dr Phil Gregory.

10. On 21 November 2024 Dr Phil Gregory and the Nurse made unannounced visit to my home. I think if I had turned off the recording as he DEMANDED, despite having a FRIEND in my home, he would have done what he came to do.

11. The fact I was on the Housing Ombudsman ZOOM on the 20 December 2024 as a member of the Resident Panel must be evidence. I discussed this with the Solicitor who refused to use it for my ARGUMENTS.

12. I am invited to apply for the post of Customer Panel after I was the Minute Taker for the disbanded “Scrutiny Customer Panel” in 2020.

13. Ms H Presley found me online when Ms Hermoine Cameron was advocating on my behalf. I asked the Solicitor to represent Ms Presley to have a STRONG case against the CLAIMANT.

14. I am a victim of the Alma Grove Hate MOBS. The aim is to PROVOKE me to get a reaction so they can say I am the AGGRESSOR.

15. Dr Phil Gregory called my son in Jamaica to ask if he thinks I will be PHYSICAL with the NEIGHBOURS.

16. I was locked out on the 23 October 2024.

17. On the 9 August 2024 I was visited at home by 2 Female Police Officers. I raised a complaint, and it goes the way of others. The Police is still INVESTIGATING.

18. On 8 August 2024 Joe Hooper surrounded my window shouting for Kevin to come outside for him to sort him out.

19. The Police who came treated me and my son as CRIMINALS.

HMCTS Miscarriages of Justice

Because there is no CONSISTENCY FAMILARITY CONTINUITY coming out of the way how information is shared. I must come to the conclusion that I am getting treated this way to cover the fact that there has been SYSTEMIC DISCRIMINATION against me. I will as the Solicitor and Barrister Ms Miranda Grell to ask for a REVIEW of my CASES dating back to Kings College Hospital NHS Foundation Trust. I will provide any EVIDENCE that is RELEVANT. What does it mean when the CLAIMS are EVACUATED? Because I have had claims in which I represented myself evacuated without EXPLANATIONS. I will end by saying Dr Phil Gregory is/was not my psychiatrist and I was not diagnosed with psychosis. Nor was I treated under Dr Gregory’s TEAM, prescribed any medication. The Solicitor must disclose the Psychiatric Assessment I attended on 15 April 2024. Failure to do so constitute breaches of the Equality Act 2010 Protected Characteristics. The fact that Dr Phil Gregory failed to respond to my concerns is proof that Housing for Women unlawful injunction K05EC530 will be going in the PUBLIC DOMAIN to help Ms H Presley and other tenants targeted by landlords.

This is the hearing of the Claimant’s committal application, dated 28 November 2023 (p. 50 – 59). The Claimant, Housing for Women, is represented by Mr Tristan Salter of Counsel. The Defendant, Ms Myers, appears in person, assisted by her McKenzie Friend, Theresa White. There is before the Court a committal bundle of 616 pages. References to page numbers in this judgment are to the committal bundle. Instagram post threatening District Judge 5. 6. I mention at the very outset that the Court has been alerted to the fact that on Monday 17 March 2025, the Defendant posted a video on Instagram in which she said, “District Judge Beecham, I’m going to take you out. Bitch, District Judge Beecham, I’m going to take you out. And this is how I’m going to take you out, Motherfucker. [She shows her computer screen, which is displaying the notice of DJ Beecham’s appointment as a Judge] … Is Tristan Salter your man, bitch? Bitch Sara Elizabeth Beecham. … Bitch, I’m coming after you.” This hearing is to sentence the Defendant for six admitted breaches of an injunction order. The Court is not sentencing the Defendant for the video posted on Instagram on 17 March 2025. However, this video is relevant to the issue of whether the injunction order should be extended in time and whether the groups of persons protected by the injunction should be widened to include all members of the Judiciary, all members of the legal profession and all HMCTS court staff. Background 7. 8. 9. As already stated, this hearing is for the purpose of considering the sentence for the Defendant’s admitted six breaches of the injunction. The Claimant is the owner of Flat 16, Alma Grove, London SE1 5PY (the Property). The Property was let to the Defendant pursuant to an assured tenancy agreement, which began on 1 December 2000 (p. 111 – 130). In the witness statement of Trina Philbert, Neighbourhood Officer at Housing for Women, dated 21 July 2023, she says (p. 132), “5. There have been multiple incidents of anti-social behaviour reported to the claimant and/or the police relating to the defendant in or around the property since May 2022. The antisocial behaviour appears in the form of racist and threatening language against residents in or around the property and the claimant’s staff and posting slanderous and inflammatory material against other residents and the claimant’s employees.” Double-click to enter the short title HHJ RICHARD ROBERTS Approved Judgment 10. The Claimant obtained a final injunction order against the Defendant, dated 1 August 2023 (p. 12 – 14). The Court ordered that: “MERVELEE MYERS Is forbidden (whether by herself or by instructing or encouraging or permitting any other person) from: 1. Causing nuisance, annoyance or distress to any person, or allowing any other visitor/s or occupant of Flat 16, Alma Grove, London, SC1 5PY (the Property) to cause a nuisance, annoyance or distress to any person of the following people: a. Any person with a right (of whatever description) to reside at Alma Grove, London, SE1 5PY (Alma Grove) or any lawful visitor to Alma Grove; and b. Any member of the claimant, staff, agents or contractors; c. Any member, employee, consultant or agent of Devonshires Solicitors LLP, 30 Finsbury circus, London, EC2M 7DT; d. Any person engaging in lawful activity in or around the locality of the property. 2. Using or threatening to use violence or allowing any visitor or occupant of the property to use or threaten to use violence, towards any person in categories 1 (a) to (d); 3. Intimidating or acting in an intimidating manner, or allowing any visitor or occupant of the property to intimidate or act in an intimidating manner towards any person in any of the categories set out in paragraph 1 (a) to (d); 4. Harassing or attempting to harass, or allowing any visitor or occupant of the property to harass or attempting to harass, be it physically or verbally towards any person in any of the categories set out in paragraph 1 (a) to (d); 5. Naming and making any reference whatsoever to any of the people referred to at paragraph 1 (a) to (d) on any social media or electronic network or platform or other including but not limited to WordPress, TikTok and YouTube. And further ordered that the said Mervelee Myers must forthwith upon service of this order 6. Remove all videos uploaded content from all social media or electronic networks or platforms or other including those referred to at paragraph 5 above whereby the individuals referred Double-click to enter the short title HHJ RICHARD ROBERTS Approved Judgment to at paragraph 1 (a) to (d), the landlord and the firm have been named, and 7. Remove all posters from the communal areas of Alma Grove and from the windows of the Property. Paragraphs 1 to 7 of this order will remain in force until 12.00 noon on the 1st August 2024, unless before then this order is varied or revoked by a further order of the court” 11. 12. 13. By her order dated 9 July 2024, District Judge Beecham ordered: “2. The injunction order dated 01.08.2023 is extended on the same terms to the final determination of the penalty on the committal application or further order. 3. Personal service of this order is dispensed with, the defendant having been in court and having been informed that the injunction would be extended.” The Claimant has summarised the Defendant’s breaches of the injunction order in a schedule dated 28 November 2023 (p. 60 – 64). The Defendant has not herself filed any witness statement in the committal proceedings. 15. 16. The Defendant was born on 19 May 1959 and is now aged 65. In the committal bundle is a report from Dr Babtunde Oyedeji Oyebode, Responsible Officer and Consultant Forensic Psychiatrist, dated 29 April 2024 (562 – 592). Dr Oyebode says in her report (578), “3.5 She has been reported to have suffered with anxiety and depression, for which she received counselling sessions with good effect. She is currently on no treatment.” 3.6 She has been assessed on several occasions by various services, including secondary mental health services, and has not been accepted for treatment, as her condition has not been deemed serious enough to require care by secondary mental health services. I note that she is awaiting referral to IAPT from the entry in the GP record of 11 January 2024. 3.7 I consider that this is appropriate, as she appears to have benefitted from counselling for her anxiety and depression in the past. The Defendant was bereaved of her late husband, Mr Tomlinson, who passed away aged 101 on 8 April 2024. The Defendant was married to Mr Tomlinson for 10 years and had been his sole carer. Dr Oyebode was asked, “3.25 whether in your professional opinion the burden for caring for her late husband played any role or contributed to the behaviours she is alleged to have displayed during the relevant?” Dr Oyebode replied: “3.26 I consider that the burden of caring for her late husband would have played a role, indeed compounded the behaviour she is alleged to have displayed during the relevant, in view of her history of experiencing symptoms of anxiety and depression in the past.” Allegation 1 17. Allegation 1 (p. 62) states that the Defendant breached paragraphs 5 and 6 of the injunction order on 3 August 2023 by posting a video on Youtube whereby the Defendant named both the Claimant and Devonshires Solicitors LLP and referred to both as “#criminals”. At Exhibit SG1 to the witness statement of Samantha Gibbs, dated 31 August 2023 there is a screenshot of the Defendant’s posts on social media (p. 303 – 304), showing the post: “#fight4justice #expose @housingforwomen8227 & @devonshires @metpolice-uk #criminals.” Double-click to enter the short title HHJ RICHARD ROBERTS Approved Judgment Allegation 2 18. Allegation 2 (62) states that the Defendant breached paragraphs 5 and 6 of the injunction order on 6 August 2023 by posting on WordPress, “Trolls Scammers Target Mervelee Myers TikTok Join List of Systemic Discrimination District Judge Sterlini Presided Over Housing For Women Terror Cells Of Devonshires Solicitors”. Screenshots of this post are at page 305. Allegation 3 19. Allegation 3 (62) states that the Defendant breached paragraphs 5 and 6 of the injunction order on 7 August 2023 by posting WordPress, “District Judge Sterlini To Be Party To Systemic Discrimination At Clerkenwell Shoreditch Involve In CCMCC Winsome Duncan Scam Housing For Women Devonshires Solicitors LLP Terrorism Deborah Agnes Gilchrist An Alcoholic Turn Drugs Abuser For Whom Beg The Police To Get Help For Each Time She Makes Malicious Allegations Against Me The World Must Know UK Is Racist Society Target BAME People Label US Violent Criminals Need ERT Whilst Husband And I Traumatised By Hate Crimes 7/8/23.” There is a screenshot of the Defendant’s blog post at page 308. Allegation 4 20. Allegation 4 (62-63) states that the Defendant breached paragraphs 1, 5 and 6 of the injunction order on 31 August 2023 by failing to remove the video on TikTok whereby the Defendant names Michael Lewis, a solicitor of Devonshires LLP. In the video, the Defendant refers to Mr Lewis as “a Cunt”. A screenshot of the video is at page 311. Allegation 5 21. Allegation 5 (63) states that the Defendant breached paragraphs 1, 5 and 6 of the injunction order on 31 August 2023 by failing to remove the video on Youtube and/or TikTok whereby the Defendant posts the contact details of Narin Masera (a Trainee Chartered Legal Executive of Devonshires Solicitors LLP) which include Ms Masera’s name, direct dial and email address. There is a screenshot of the video at page 312, which gives Ms Masera’s contact details and then says, “so Housing for Women the TERRORISM CELL is getting Devonshires involved their Hate Crime Against MM.” Allegation 6 22. 23. Allegation 6 (63) states that the Defendant breached paragraphs 1, 4 and 5 of the injunction order on 7 November 2023 by posting a video on YouTube in which she named Ms Masera and referred to her as “a terrorist”, “a bully”, “a racist”, “a coward”, “a gutless excuse for a female”, a “bitch” and a “cunt”.” Ms Masera is a Trainee Chartered Legal Executive at Devonshires. She has provided a witness statement, dated 28 November 2023 (264 – 267), in which she says at paragraphs 5 and 6 that on 7 November 2023 the Defendant called her on her direct dial. Ms Masera did not answer. The Defendant left her a voicemail, which stated, “Hi Devonshires Solicitors Narin Masera Double-click to enter the short title HHJ RICHARD ROBERTS Approved Judgment This is Mervelee Myers The reference is NZM/HOU16/258 I am calling about your terrorist activities against me from the time I received a letter and just in case this is going over I am doing a live yeah I am doing a live Narin Masera Terrorist Narin Masera I’m doing a live before I am due to go for my whatever it is flu” 24. 25. 26. In her witness statement, Ms Masera says, “7. Following this, I received an e-mail from the Defendant timed 12.29pm on the same date, the subject of which was “Narin Masera the Terrorist”. Within the body of the e-mail is a link to a YouTube video. … 8. The video that the defendant has uploaded to YouTube is entitled “My #views #defamation 100” and within the video the defendant can be seen calling me, repeating my name and referring to me as a terrorist, a bully, a racist, a coward, “a gutless excuse for a female”, a “bitch” and a “cunt”. … 9. This is not the first time the defendant has behaved in this manner towards me, details of the previous incident can be seen at paragraph 7 (xix) of the witness statement of Trina Philbert dated 21 July 2023 and exhibit “TP1”. 10. After listening to the Defendant’s voicemail and receiving the Defendant’s e-mail on 7 November 2023, I felt upset and concerned that the Defendant continued to publicly broadcast untrue and malicious lies about me by posting these on social media platforms. The Defendant’s behaviour is causing me significant stress as to be labelled as a “terrorist” is deeply concerning and is not something I take lightly. As such, I reported this to the Police on 7 November 2023 and the reference is CAD 319 9/07Nov23.” Trina Philbert says in her first witness statement, dated 13 December 2023 (108), “13. The Defendant’s behaviour is having a widespread and detrimental effect on those individuals targeted and the Claimant’s staff members.” The order of DJ Beecham, dated 9 July 2024, (which has not been included in bundle), includes the following recitals: “UPON the Defendant attending and admitting all the allegations in the contempt application and service of the injunction dated 01.08.2023 on 03.08.2023 Double-click to enter the short title HHJ RICHARD ROBERTS Approved Judgment AND UPON the court adjourning to give the Defendant opportunity to show compliance with the injunction order and adduce further medical evidence on penalty AND UPON the parties submitting and the court accepting that the initial view on penalty is that the breaches fall within category B3 of the CJC Anti-Social behaviour and the Civil courts Report, with the range of penalty being adjourn consideration to 1 month custody AND UPON the court taking into account that good behaviour will be a mitigating factor and any relevant medical evidence may be mitigation and further breaches will be aggravating factors and the court noting the challenging circumstances with which the Defendant has had to contend in the recent past such as the bereavements suffered, will be relevant mitigation AND UPON the Claimant making an unopposed oral application to extend the injunction order dated 01.08.2023 AND UPON the Defendant confirming orally that she understands the injunction shall continue” Decision 27. 28. 29. 30. 31. Mr Salter referred the Court to the leading case of Lovett v Wigan Borough Council [2022] EWCA Civ 1631. Regarding the issues of harm and culpability, I have had regard to paragraphs 46 to 57 of the judgment of Birss LJ. I find that the Defendant’s culpability falls within band B of the Sentencing Council’s guideline grid. I find that the harm caused by the Defendant falls within Category 3 of the grid. I accept the evidence of Ms Masera in her witness statement (266), dated 28 November 2023, at paragraph 10 that the Defendant’s behaviour is deeply concerning and is causing her significant stress. She felt upset. She reported the matter to the police. I also take into account that Ms Philbert says in her first witness statement, dated 13 December 2023, at paragraph 13 (108) that the Defendant’s behaviour is having a widespread and detrimental effect on those individuals targeted and the Claimant’s staff members. The starting point for B3 is adjourned consideration and the category range is adjourned consideration to 1 month. I find that the Defendant’s culpability is aggravated by the fact that there are six breaches of the injunction order. I find that a further aggravating factor is that the Defendant was advised on two occasions by District Judge Beecham of the importance of compliance with the injunction: i) By an order dated 9 July 2024, District Judge Beecham included the recital, Double-click to enter the short title HHJ RICHARD ROBERTS Approved Judgment “AND UPON the court adjourning to give the Defendant opportunity to show compliance with the injunction order and adduce further medical evidence on penalty” ii) 32. District Judge Beecham reiterated to the Defendant the importance of the Defendant showing compliance with the injunction order in her order of 18 September 2024, where she said in the recital: “AND UPON the court explaining to the Defendant the importance of compliance with the injunction dated 01.08.23 as extended by the order dated 12.06.2024 and explaining that the injunction remains in force on the same terms until 20.01.2025 or such other date as penalty is determined or further order.” Despite this, I am told by Mr Salter, and accept, that there have been further breaches of the injunction order. 33. 34. 35. On the other hand, I find that there are the following factors which mitigate the Defendant’s culpability: i) ii) iii) iv) At the hearing on 9 July 2024, the Defendant pleaded guilty to the 6 allegations in the contempt application. Whilst the plea of guilty was not at the first hearing and the evidence for the allegations was very strong, bearing in mind the existence of the video footage on social media, I nevertheless give the Defendant credit for her plea of guilty, which has saved witnesses from being required to attend Court. The Defendant repeatedly said in her oral submissions to the Court today that she needed help. I bear in mind that the Defendant is vulnerable because of her anxiety and depression. I also bear in mind that Dr Oyebode said in his report: “3.26 I consider that the burden of caring for her late husband would have played a role, indeed compounded the behaviour she is alleged to have displayed during the relevant, in view of her history of experiencing symptoms of anxiety and depression in the past.” The Defendant has not previously received a custodial sentence. Having regard to all the circumstances, including the seriousness of the six breaches of the injunction order and the fact that the Defendant has continued to breach the injunction order despite District Judge Beecham explaining to the Defendant on two occasions that the Court was adjourning sentencing to give the Defendant an opportunity to show compliance with the injunction order, I find that the custody threshold is passed and a sentence of imprisonment is appropriate. I bear in mind that the Court must impose the shortest period of imprisonment which properly reflects the seriousness of the contempt. I have also stood back and considered the totality of the evidence. Double-click to enter the short title HHJ RICHARD ROBERTS Approved Judgment 36. 37. 38. I conclude that the appropriate period of custody, having regard to all the circumstances, including the aggravating and mitigating factors is one month, concurrent on each of the 6 charges. I must next consider whether the sentence should be suspended. I find that whether the custodial sentence should be immediate or suspended is finely balanced. However, having regard to the Defendant’s vulnerability and the fact that she has not received a term of imprisonment, immediate or suspended in the past, I find that the just and proportionate sentence is to suspend the sentence on condition that the Defendant complies with the injunction order dated 1 August 2023 and any variations, including that set out below, for a period of two years from today’s date, ending at 4pm on 19 March 2027 or on further order of the Court. Allegations 2 and 3 involve the Defendant naming and making offensive comments about a District Judge. As recently as 17 March 2025, the Defendant posted on social media a video in which she made threatening and abusive comments about another District Judge. Having regard to the this, I order that paragraph 1 of the injunction order is amended to include a new paragraph 1(e): “(1)(e) All members of the judiciary, all members of the legal profession, and all HMCTS court staff. ” Right of appeal 39. Costs 40. 41. 42. 43. I advise the Defendant that she has an automatic right of appeal to the Court of Appeal. She does not need to request permission to appeal. An appeal must be made within 21 days of today. I find that costs should follow the event, pursuant to CPR 44.2(2). The Defendant has served an N260 statement of costs, dated 6 March 2025, totalling £21,814.80. I find that the hourly rates are far below the guideline rates, and that the time sought for the work carried out is reasonable. I conclude that the sum sought is both proportionate and reasonable. I order that the Defendant pay the sum of £21,814.80, not to be enforced without an assessment of the Defendant’s ability to pay under s.26 LASPO 2012, the assessment to include the determination of the period in which the Defendant had costs protection. Finally, I warn the Defendant that the consequences of breaching the injunction order are likely to be very serious and include the activation of the suspended sentence. The injunction order will remain in force for two years from today’s date until 4pm on 19 March 2027. I emphasize to the Defendant that she must not cause nuisance, annoyance or distress to any of the persons mentioned at paragraph 1(a) to (e) of the injunction order.

This is the hearing of the Claimant’s committal application, dated 28 November 2023 (p. 50 – 59). The Claimant, Housing for Women, is represented by Mr Tristan Salter of Counsel. MM Response: Was Tristan Salter groomed by DJ Sara Elizabeth Beecham who wanted to keep the case, but chicken out when I raised the HCT Group Impact Report 2016 of 1 in 5 of all suicides are associated with unemployment (pages 8-9). The Defendant, Ms Myers, appears in person, assisted by her McKenzie Friend, Theresa White. MM Response: Why Did DJ Beecham not allow the McKenzie Friend to talk in her Court? I knew nothing about McKenzie Friend and my this time the RANTING RAVING LUNATIC triggered my ATYPICAL PARKINSONYSM I was unable to function. There is before the Court a committal bundle of 616 pages. References to page numbers in this judgment are to the committal bundle. Instagram post threatening District Judge 5. 6. I mention at the very outset that the Court has been alerted to the fact that on Monday 17 March 2025, the Defendant posted a video on Instagram in which she said, “District Judge Beecham, I’m going to take you out. Bitch, District Judge Beecham, I’m going to take you out. And this is how I’m going to take you out, Motherfucker. [She shows her computer screen, which is displaying the notice of DJ Beecham’s appointment as a Judge] … Is Tristan Salter your man, bitch? Bitch Sara Elizabeth Beecham. … Bitch, I’m coming after you.” This hearing is to sentence the Defendant for six admitted breaches of an injunction order. The Court is not sentencing the Defendant for the video posted on Instagram on 17 March 2025. MM Response: The fact the DJ Beecham did not complete the case and sent a RANTING RAGING LUNATIC mentioning Winsome Duncan And DJ Sterlini are causes for concerns. At the time I was not aware of the name, but HHJ Richard Roberts imposed a Civil Restraint Order on me after DJ Swan strike out 5 Claims they were without merit, and I objected. If I die, my stories will serve future generations to avoid the pitfalls I have been down. Barrister Samantha Jones tried to take out ECRO, but did not succeed. However, this video is relevant to the issue of whether the injunction order should be extended in time and whether the groups of persons protected by the injunction should be widened to include all members of the Judiciary, all members of the legal profession and all HMCTS court staff. MM Response: We should therefore go back to Kings College Hospital NHS Foundation Trust when I had the first nevous breakdown after the death of my brother WALFORD BYRON ALBURNEY NEMBHARD. I represented myself then even though I had no legal knowledge. As already stated, this hearing is for the purpose of considering the sentence for the Defendant’s admitted six breaches of the injunction. MM Response: I will bring my old folks saying to let the Reader understand how I was stitched up by JI Solicitors Sola Obajuluwa and Barrister Miranda Grell. After Charles Hills & CO Stephen Agera abandoned me via email when I got to Court on the 19th December 2023. Barrister Angela Delbourg had told me that I must be WHITER than WHITE and she thought I would SHOUT at DJ Richard Hayes when she represented me. The Claimant is the owner of Flat 16, Alma Grove, London SE1 5PY (the Property). The Property was let to the Defendant pursuant to an assured tenancy agreement, which began on 1 December 2000 (p. 111 – 130). In the witness statement of Trina Philbert, Neighbourhood Officer at Housing for Women, dated 21 July 2023, she says (p. 132), “5. There have been multiple incidents of anti-social behaviour reported to the claimant and/or the police relating to the defendant in or around the property since May 2022. MM Response: When did Trina Philbert started working with H4W? Why did H4W wiped the Customer Portal of all my DATA after refusing me ACCESS? What roles if any did MERVELEE MYERS played during my time at H4W before Samantha Gibbs and Trina Philbert started working for H4W in 2022? The antisocial behaviour appears in the form of racist and threatening language against residents in or around the property and the claimant’s staff and posting slanderous and inflammatory material against other residents and the claimant’s employees.” MM Response: Why did MM started doing this? MM Response: Mervelee Myers was not made aware of this until after the injunction by DJ Sterlini. And that’s why I called HHJ Richard Roberts a RANTING RAVING LUNATIC because he mentioned Winsome Duncan and DJ Sterlini. Now who is Winsome Duncan and what role did DJ Sterlini played in the Case of Winsome Duncan. She stole my MANUSCRIPT and sent the Met Police and London Ambulance Service to section me from a malicious report I wrote on Facebook, I was feeling SUICIDAL. The Court ordered that: “MERVELEE MYERS Is forbidden (whether by herself or by instructing or encouraging or permitting any other person) from: 1. Causing nuisance, annoyance or distress to any person, or allowing any other visitor/s or occupant of Flat 16, Alma Grove, London, SC1 5PY (the Property) to cause a nuisance, annoyance or distress to any person of the following people: MM Response: MM was not GUILTY of this and this can be referenced online, but HMCTS with their agenda to SILENCE me was only interested in doing exactly this. a. Any person with a right (of whatever description) to reside at Alma Grove, London, SE1 5PY (Alma Grove) or any lawful visitor to Alma Grove; and MM Response: Since I am the person who was a victim after H4W coerced Ms Gilchrist to target me. The Court should investigate how the tenant before me was treated. I have rights as a tenant at Alma Grove by my ENTITLEMENTS of affording H4W privileges to handing over my key for them to get copy. This key was then used to allow persons to gain entry to DISCRIMINATE against me. Ms Gilchrist a convicted Drink Driver has used to property do do business, some of which are/were ILLEGAL. All types of people visited Alma Grove at all hours of the day and night. b. Any member of the claimant, staff, agents or contractors; MM Response: Check Social Media to verify how I facilitated the Claimant staff, agents or contractors to understand that my RECORD will be viewed online even after am dEAD. c. Remove all posters from the communal areas of Alma Grove and from the windows of the Property. Paragraphs 1 to 7 of this order will remain in force until 12.00 noon on the 1st August 2024, unless before then this order is varied or revoked by a further order of the court” 11. 12. 13. By her order dated 9 July 2024, District Judge Beecham ordered: “2. The injunction order dated 01.08.2023 is extended on the same terms to the final determination of the penalty on the committal application or further order. MM Response: DJ Beecham is party to the DISCRIMINATION. 3. Personal service of this order is dispensed with, the defendant having been in court and having been informed that the injunction would be extended.” The Claimant has summarised the Defendant’s breaches of the injunction order in a schedule dated 28 November 2023 (p. 60 – 64). I have taken into account the following written evidence: i) ii) iii) Trina Philbert, a Neighbourhood Officer employed by the Claimant: a) b) c) d) First witness statement, dated 13 December 2023 (p. 100 – 108) and exhibit TP1 (p. 110 – 195); Second witness statement, dated 16 November 2023 (196 – 200) and exhibit TP2 (202 – 203); Sworn affidavit of Trina Philbert, dated 12 January 2024 (396 – 397); Second affidavit of Trina Philbert, undated and unsigned (408 – 415) and exhibit TF2 (416 – 463). MM Response: When did Trina Philbert started working with H4W. Narin Masera, Trainee Chartered Legal Executive at Devonshires Solicitors: a) b) c) Witness statement, dated 10 November 2023 (313 – 315) and exhibit NM1 (316 – 319); Sworn affidavit, dated 28 November 2023 (264 – 267) and exhibit NM1 (268 – 272). Second sworn affidavit, dated 30 May 2024 (399 – 401) and exhibit NM2 (402 – 407) Sworn affidavit of Samantha Gibbs, Housing Team Leader employed by the Claimant, dated 31 August 2023 (285 – 291). Double-click to enter the short title HHJ RICHARD ROBERTS Approved Judgment iv) 14. Witness statement of Stephen Agera, solicitor for the Defendant, dated 17 August 2023 (42 – 43). The Defendant has not herself filed any witness statement in the committal proceedings. 15. 16. The Defendant was born on 19 May 1959 and is now aged 65. In the committal bundle is a report from Dr Babtunde Oyedeji Oyebode, Responsible Officer and Consultant Forensic Psychiatrist, dated 29 April 2024 (562 – 592). Dr Oyebode says in her report (578), “3.5 She has been reported to have suffered with anxiety and depression, for which she received counselling sessions with good effect. She is currently on no treatment.” 3.6 She has been assessed on several occasions by various services, including secondary mental health services, and has not been accepted for treatment, as her condition has not been deemed serious enough to require care by secondary mental health services. I note that she is awaiting referral to IAPT from the entry in the GP record of 11 January 2024. 3.7 I consider that this is appropriate, as she appears to have benefitted from counselling for her anxiety and depression in the past. The Defendant was bereaved of her late husband, Mr Tomlinson, who passed away aged 101 on 8 April 2024. The Defendant was married to Mr Tomlinson for 10 years and had been his sole carer. Dr Oyebode was asked, “3.25 whether in your professional opinion the burden for caring for her late husband played any role or contributed to the behaviours she is alleged to have displayed during the relevant?” Dr Oyebode replied: “3.26 I consider that the burden of caring for her late husband would have played a role, indeed compounded the behaviour she is alleged to have displayed during the relevant, in view of her history of experiencing symptoms of anxiety and depression in the past.” Allegation 1 17. Allegation 1 (p. 62) states that the Defendant breached paragraphs 5 and 6 of the injunction order on 3 August 2023 by posting a video on Youtube whereby the Defendant named both the Claimant and Devonshires Solicitors LLP and referred to both as “#criminals”. At Exhibit SG1 to the witness statement of Samantha Gibbs, dated 31 August 2023 there is a screenshot of the Defendant’s posts on social media (p. 303 – 304), showing the post: “#fight4justice #expose @housingforwomen8227 & @devonshires @metpolice-uk #criminals.” Double-click to enter the short title HHJ RICHARD ROBERTS Approved Judgment Allegation 2 18. Allegation 2 (62) states that the Defendant breached paragraphs 5 and 6 of the injunction order on 6 August 2023 by posting on WordPress, “Trolls Scammers Target Mervelee Myers TikTok Join List of Systemic Discrimination District Judge Sterlini Presided Over Housing For Women Terror Cells Of Devonshires Solicitors”. Screenshots of this post are at page 305. Allegation 3 19. Allegation 3 (62) states that the Defendant breached paragraphs 5 and 6 of the injunction order on 7 August 2023 by posting WordPress, “District Judge Sterlini To Be Party To Systemic Discrimination At Clerkenwell Shoreditch Involve In CCMCC Winsome Duncan Scam Housing For Women Devonshires Solicitors LLP Terrorism Deborah Agnes Gilchrist An Alcoholic Turn Drugs Abuser For Whom Beg The Police To Get Help For Each Time She Makes Malicious Allegations Against Me The World Must Know UK Is Racist Society Target BAME People Label US Violent Criminals Need ERT Whilst Husband And I Traumatised By Hate Crimes 7/8/23.” There is a screenshot of the Defendant’s blog post at page 308. Allegation 4 20. Allegation 4 (62-63) states that the Defendant breached paragraphs 1, 5 and 6 of the injunction order on 31 August 2023 by failing to remove the video on TikTok whereby the Defendant names Michael Lewis, a solicitor of Devonshires LLP. In the video, the Defendant refers to Mr Lewis as “a Cunt”. A screenshot of the video is at page 311. Allegation 5 21. Allegation 5 (63) states that the Defendant breached paragraphs 1, 5 and 6 of the injunction order on 31 August 2023 by failing to remove the video on Youtube and/or TikTok whereby the Defendant posts the contact details of Narin Masera (a Trainee Chartered Legal Executive of Devonshires Solicitors LLP) which include Ms Masera’s name, direct dial and email address. There is a screenshot of the video at page 312, which gives Ms Masera’s contact details and then says, “so Housing for Women the TERRORISM CELL is getting Devonshires involved their Hate Crime Against MM.” Allegation 6 22. 23. Allegation 6 (63) states that the Defendant breached paragraphs 1, 4 and 5 of the injunction order on 7 November 2023 by posting a video on YouTube in which she named Ms Masera and referred to her as “a terrorist”, “a bully”, “a racist”, “a coward”, “a gutless excuse for a female”, a “bitch” and a “cunt”.” Ms Masera is a Trainee Chartered Legal Executive at Devonshires. She has provided a witness statement, dated 28 November 2023 (264 – 267), in which she says at paragraphs 5 and 6 that on 7 November 2023 the Defendant called her on her direct dial. Ms Masera did not answer. The Defendant left her a voicemail, which stated, “Hi Devonshires Solicitors Narin Masera Double-click to enter the short title HHJ RICHARD ROBERTS Approved Judgment This is Mervelee Myers The reference is NZM/HOU16/258 I am calling about your terrorist activities against me from the time I received a letter and just in case this is going over I am doing a live yeah I am doing a live Narin Masera Terrorist Narin Masera I’m doing a live before I am due to go for my whatever it is flu” 24. 25. 26. In her witness statement, Ms Masera says, “7. Following this, I received an e-mail from the Defendant timed 12.29pm on the same date, the subject of which was “Narin Masera the Terrorist”. Within the body of the e-mail is a link to a YouTube video. … 8. The video that the defendant has uploaded to YouTube is entitled “My #views #defamation 100” and within the video the defendant can be seen calling me, repeating my name and referring to me as a terrorist, a bully, a racist, a coward, “a gutless excuse for a female”, a “bitch” and a “cunt”. … 9. This is not the first time the defendant has behaved in this manner towards me, details of the previous incident can be seen at paragraph 7 (xix) of the witness statement of Trina Philbert dated 21 July 2023 and exhibit “TP1”. 10. After listening to the Defendant’s voicemail and receiving the Defendant’s e-mail on 7 November 2023, I felt upset and concerned that the Defendant continued to publicly broadcast untrue and malicious lies about me by posting these on social media platforms. The Defendant’s behaviour is causing me significant stress as to be labelled as a “terrorist” is deeply concerning and is not something I take lightly. As such, I reported this to the Police on 7 November 2023 and the reference is CAD 319 9/07Nov23.” Trina Philbert says in her first witness statement, dated 13 December 2023 (108), “13. The Defendant’s behaviour is having a widespread and detrimental effect on those individuals targeted and the Claimant’s staff members.” The order of DJ Beecham, dated 9 July 2024, (which has not been included in bundle), includes the following recitals: “UPON the Defendant attending and admitting all the allegations in the contempt application and service of the injunction dated 01.08.2023 on 03.08.2023 Double-click to enter the short title HHJ RICHARD ROBERTS Approved Judgment AND UPON the court adjourning to give the Defendant opportunity to show compliance with the injunction order and adduce further medical evidence on penalty AND UPON the parties submitting and the court accepting that the initial view on penalty is that the breaches fall within category B3 of the CJC Anti-Social behaviour and the Civil courts Report, with the range of penalty being adjourn consideration to 1 month custody AND UPON the court taking into account that good behaviour will be a mitigating factor and any relevant medical evidence may be mitigation and further breaches will be aggravating factors and the court noting the challenging circumstances with which the Defendant has had to contend in the recent past such as the bereavements suffered, will be relevant mitigation AND UPON the Claimant making an unopposed oral application to extend the injunction order dated 01.08.2023 AND UPON the Defendant confirming orally that she understands the injunction shall continue” Decision 27. 28. 29. 30. 31. Mr Salter referred the Court to the leading case of Lovett v Wigan Borough Council [2022] EWCA Civ 1631. Regarding the issues of harm and culpability, I have had regard to paragraphs 46 to 57 of the judgment of Birss LJ. I find that the Defendant’s culpability falls within band B of the Sentencing Council’s guideline grid. I find that the harm caused by the Defendant falls within Category 3 of the grid. I accept the evidence of Ms Masera in her witness statement (266), dated 28 November 2023, at paragraph 10 that the Defendant’s behaviour is deeply concerning and is causing her significant stress. She felt upset. She reported the matter to the police. I also take into account that Ms Philbert says in her first witness statement, dated 13 December 2023, at paragraph 13 (108) that the Defendant’s behaviour is having a widespread and detrimental effect on those individuals targeted and the Claimant’s staff members. The starting point for B3 is adjourned consideration and the category range is adjourned consideration to 1 month. I find that the Defendant’s culpability is aggravated by the fact that there are six breaches of the injunction order. I find that a further aggravating factor is that the Defendant was advised on two occasions by District Judge Beecham of the importance of compliance with the injunction: i) By an order dated 9 July 2024, District Judge Beecham included the recital, Double-click to enter the short title HHJ RICHARD ROBERTS Approved Judgment “AND UPON the court adjourning to give the Defendant opportunity to show compliance with the injunction order and adduce further medical evidence on penalty” ii) 32. District Judge Beecham reiterated to the Defendant the importance of the Defendant showing compliance with the injunction order in her order of 18 September 2024, where she said in the recital: “AND UPON the court explaining to the Defendant the importance of compliance with the injunction dated 01.08.23 as extended by the order dated 12.06.2024 and explaining that the injunction remains in force on the same terms until 20.01.2025 or such other date as penalty is determined or further order.” Despite this, I am told by Mr Salter, and accept, that there have been further breaches of the injunction order. 33. 34. 35. On the other hand, I find that there are the following factors which mitigate the Defendant’s culpability: i) ii) iii) iv) At the hearing on 9 July 2024, the Defendant pleaded guilty to the 6 allegations in the contempt application. Whilst the plea of guilty was not at the first hearing and the evidence for the allegations was very strong, bearing in mind the existence of the video footage on social media, I nevertheless give the Defendant credit for her plea of guilty, which has saved witnesses from being required to attend Court. The Defendant repeatedly said in her oral submissions to the Court today that she needed help. I bear in mind that the Defendant is vulnerable because of her anxiety and depression. I also bear in mind that Dr Oyebode said in his report: “3.26 I consider that the burden of caring for her late husband would have played a role, indeed compounded the behaviour she is alleged to have displayed during the relevant, in view of her history of experiencing symptoms of anxiety and depression in the past.” The Defendant has not previously received a custodial sentence. Having regard to all the circumstances, including the seriousness of the six breaches of the injunction order and the fact that the Defendant has continued to breach the injunction order despite District Judge Beecham explaining to the Defendant on two occasions that the Court was adjourning sentencing to give the Defendant an opportunity to show compliance with the injunction order, I find that the custody threshold is passed and a sentence of imprisonment is appropriate. I bear in mind that the Court must impose the shortest period of imprisonment which properly reflects the seriousness of the contempt. I have also stood back and considered the totality of the evidence. Double-click to enter the short title HHJ RICHARD ROBERTS Approved Judgment 36. 37. 38. I conclude that the appropriate period of custody, having regard to all the circumstances, including the aggravating and mitigating factors is one month, concurrent on each of the 6 charges. I must next consider whether the sentence should be suspended. I find that whether the custodial sentence should be immediate or suspended is finely balanced. However, having regard to the Defendant’s vulnerability and the fact that she has not received a term of imprisonment, immediate or suspended in the past, I find that the just and proportionate sentence is to suspend the sentence on condition that the Defendant complies with the injunction order dated 1 August 2023 and any variations, including that set out below, for a period of two years from today’s date, ending at 4pm on 19 March 2027 or on further order of the Court. Allegations 2 and 3 involve the Defendant naming and making offensive comments about a District Judge. As recently as 17 March 2025, the Defendant posted on social media a video in which she made threatening and abusive comments about another District Judge. Having regard to the this, I order that paragraph 1 of the injunction order is amended to include a new paragraph 1(e): “(1)(e) All members of the judiciary, all members of the legal profession, and all HMCTS court staff. ” Right of appeal 39. Costs 40. 41. 42. 43. I advise the Defendant that she has an automatic right of appeal to the Court of Appeal. She does not need to request permission to appeal. An appeal must be made within 21 days of today. I find that costs should follow the event, pursuant to CPR 44.2(2). The Defendant has served an N260 statement of costs, dated 6 March 2025, totalling £21,814.80. I find that the hourly rates are far below the guideline rates, and that the time sought for the work carried out is reasonable. I conclude that the sum sought is both proportionate and reasonable. I order that the Defendant pay the sum of £21,814.80, not to be enforced without an assessment of the Defendant’s ability to pay under s.26 LASPO 2012, the assessment to include the determination of the period in which the Defendant had costs protection. Finally, I warn the Defendant that the consequences of breaching the injunction order are likely to be very serious and include the activation of the suspended sentence. The injunction order will remain in force for two years from today’s date until 4pm on 19 March 2027. I emphasize to the Defendant that she must not cause nuisance, annoyance or distress to any of the persons mentioned at paragraph 1(a) to (e) of the injunction order.
